9.32.010 Definitions.

For purposes of this chapter, the following terms shall be defined as provided in this section:

A. “Minor” means a person less than eighteen (18) years of age.

B. “Laser pointer” means any device, including but not necessarily limited to, a pointer, pen, flashlight or similar device, which emits a laser beam. [Ord. 99-07 § 2.]

9.32.020 Possession of a laser pointer by a minor.

Except as provided in this chapter, it is unlawful for a minor to possess a laser pointer outside of the presence of, and without the direct supervision of, the minor’s parent or legal guardian. [Ord. 99-07 § 2.]

9.32.030 Sale, transfer, or provision of a laser pointer to a minor.

Except as provided in this chapter, it is unlawful for a person to sell, transfer to, or otherwise provide a minor with a laser pointer unless the minor is accompanied by a parent or legal guardian at the time of the purchase or transfer. [Ord. 99-07 § 2.]

9.32.040 Liability of parent or legal guardian.

The parent or legal guardian of a minor who resides with such parent or legal guardian shall not allow such a minor to possess a laser pointer as described in this chapter, outside of the presence of, and without the direct supervision of, the parent or legal guardian. [Ord. 99-07 § 2.]

9.32.050 Harassment with a laser pointer prohibited.

It is unlawful for any person to focus, point or shine a laser pointer directly or indirectly at or on another person or animal in such a manner as to harass or annoy said person or animal, or to direct the laser beam from a laser pointer into the eye or eyes of another person or an animal. [Ord. 99-07 § 2.]

9.32.060 Violation – Penalty.

Any person who violates any section or subsection of this chapter is guilty of a violation and subject to a fine not less than fifty dollars ($50) and not to exceed three hundred dollars ($300). [Ord. 99-07 § 2.]
