2.45.010 Established--Appointment--Library commission.

A.    The library commission is established consisting of the same number of members as the borough assembly (five). The library commission shall be of volunteer status and appointed by the mayor subject to confirmation by the borough assembly.

B.    Alternate. Two alternates shall be appointed. Alternates may attend meetings and receive same compensation as regular library commission members. When an alternate or alternates fill the vacancy or vacancies of the regular library commission member(s) at a meeting they shall have all the powers of that member of the commission. 2.45.020 Term of office.

The library commission serves at the pleasure of the borough assembly. Members of the library commission shall be appointed for a term of three years except those first appointed. Members of the first library commission appointed shall determine their respective terms of office by lot so that three shall be appointed for a term of three years, two for two years and two for one year. 2.45.030 Qualification.

A borough resident is eligible to be on the volunteer library commission if he/she has resided in the borough immediately prior to appointment and is a qualified voter to the borough. (Ord. 93-8 §1(part), 1993: Ord. 92-9 (part), 1993).

2.45.040 Compensation.

Compensation and expenses of the volunteer library commission will be considered by the borough assembly upon request. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.050 Officers--Appointment--Duties.

Immediately after their appointment, the members of the library commission meet and elect a president, vice president, secretary and treasurer.

A.    President. The president shall reside as chairperson at all meetings. He/she shall appoint all committees and shall perform the duties necessary or incidental to its office.

B.    Vice president. The vice president shall be cochairperson in the absence of the chairperson or in the case of the inability of the chairperson to act.

C.    Secretary. The secretary shall be responsible for taking of the minutes.

D.    Treasurer. The treasurer shall be responsible for the maintenance of the budget or any other money making activities. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.060 Removal--Vacancy.

A member of the library commission may be removed by a majority vote of the borough assembly. A vacancy is filled in the same manner as the original appointment. A person appointed to fill a vacancy serves for the remainder of the unexpired term.

A.    A vacancy shall be declared when a member:

1.    Fails to qualify and take his/her office within thirty days after his/her confirmation by the borough assembly;

2.    Departs from the borough with the intent to remain away for a period of thirty or more days;

3.    Submits his/her resignation and the resignation is accepted by the borough assembly;

4.    Is physically or mentally unable to attend library commission meetings for a period of more than thirty days;

5.    Misses three or more consecutive regular meetings, unless excused by the library commission; and

6.    Is convicted of a felony or of an offense involving a violation of his/her oath of office. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.070 Meetings.

The regular commission shall establish a regular place of meeting and shall hold at least four regular meetings per year. Notice of regular meetings shall be preestablished by resolution. Special meetings may be called by the presiding officer or at the request of three members, including nonvoting members, upon not less than forty-eight hours’ written or oral notice communicated to each commission member. Notice of special meetings shall also be posted in three public places within the borough not less than forty-eight hours prior to the meeting date. All meetings will be open to the public. 2.45.080 Quorum.

Three members shall constitute a quorum. Any act of the library commission requires a quorum and the affirmative vote of a majority of members present and voting, and in no event fewer than two affirmative votes. Every member who is present when a question is put, where he/she is not disqualified under the provisions of Chapter 2.15, shall vote. Members who are present, but are excused from voting, shall be counted for purposes of a quorum. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.090 Conflict of interest--Voting.

The library commission shall follow the provisions of Chapter 2.15 regarding conflict-of-interest voting. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.100 Public meetings--Minutes.

The library commission shall keep a record of all business, resolutions, transactions, findings, determinations, minutes and other matters coming before it. Such record shall be filled with the borough clerk and retained as public records. (Ord. 938 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.110 Rules of proceedings.

Meetings shall be conducted under Robert’s Rules of Order, and such modified or amended rules as may be adopted by the library commission. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.120 Order of business.

A.    The order of business at regular meetings shall be:

1.    Call to order;

2.    Roll call;

3.    Agenda approval;

4.    Approval of minutes;

5.    Appearance requests;

6.    Library director’s report;

7.    Treasurer’s financial report;

8.    Communications;

9.    Old business;

10.    New business;

11.    Persons to be heard;

12.    Library commission comments; and

13.    Adjournment.

B.    The order of business at special meetings shall be the same as above. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.130 Formal acts by resolution.

A.    All formal acts of the library commission shall be by resolution bearing the following:

1.    The heading, "Bristol Bay Borough Martin Monsen Regional Library Commission";

2.    Space for the serial number to be assigned, Resolution No. ____;

3.    A short and concise title description of its subject and purpose;

4.    Short premises and whereas clauses descriptive of the reasons for the resolutions, if necessary;

5.    The resolving clause, "Be it Resolved," and (DATE) and designated lines for signature of the library commission’s presiding officer and library director.

B.    All resolutions adopted by the library commission, whether at the instance of and presented by third parties, or on the motion of and instance of the library commission, shall conform to that set forth above and shall be on white eight and one-half by eleven inch paper with one and one-half inch left margin suitable for permanent filing. 2.45.140 Powers.

A.    The library commission will establish operational policies for the library program(s), and submit same to the borough assembly for approval. All policies of the program(s) established by the library commission will become effective by borough assembly approval;

B.    Assist the library director in preparation and presentation of the annual budget request to the borough assembly, no later than April 1st of each year;

C.    Assist the library director in preparation and submission of grant application(s), to the borough assembly for approval, for the development of the library program(s);

D.    Make recommendations through the borough manager to the borough assembly concerning the library department and its program(s);

E.    Prepare a written report of the library program(s) to the borough assembly at least four times annually. In addition, the library commission may:

F.    Solicit donations of money and/or property for the benefit of the library. Any monetary donations shall be deposited to the borough finance department in a reserve account dedicated for public library use. If property, it shall be accepted by deed or other conveyance subject to approval of the borough assembly. Such property shall be disposed of for public library purposes as the borough assembly may direct. (Ord. 93-8 §1(part), 1993; Ord. 92-9 (part), 1993).

2.45.150 Duties and responsibilities.

A.    The library commission shall prepare and recommend to the borough assembly a comprehensive plan and related texts for the systematic development of the library program(s) in the borough.

The library commission shall undertake an overall review of the plan at least every five years and shall present recommendations based on the review of the assembly.

B.    The library commission may consider and investigate subject matter tending to the development and betterment of the library(s) facilities and programs in the borough and make recommendations as it considers advisable to the borough assembly.

C.    The library director of the Martin Monsen regional libraries shall be responsible for and shall have control of the library department. The library director will be responsible for the supervision of the Martin Monsen regional libraries during open hours, establishing, with the assistance of the library commission, the library policies, preparing the annual budget for the library(s), preparing and making application for grants to assist the library program(s), and organizing special library activities. 2.45.160 Use of the library.

All persons shall be extended the privilege of using the library subject to observing the rules established for the use of the library. (Ord. 92-9 (part), 1993).

2.45.170 Failure to return library property.

A.    No person shall willfully detain or fail to return library material for more than thirty days after notification has been sent by mail to the last known or registered place of resident.

B.    Any person after sufficient notice and after sixty days is in violation of subsection A of this section and shall be subject to the suspension of library privileges.

C.    Any person in violation of subsection A of this section, and after sixty days and sufficient notice of delinquency of library material, shall be billed for the full cost of library material. In the event that payment is not received within forty-five days following the first billing, the borough shall take steps as necessary to collect the bill. (Ord. 92-9 (part), 1993).

2.45.180 Damage to property and denial of library privileges.

A.    Damage to Property. No person shall willfully or intentionally damage property belonging to the Martin Monsen regional libraries located in Naknek, King Salmon and South Neknek.

B.    Denial of Library Privileges. The library director or person in authority may prohibit any person from using the Martin Monsen regional libraries who willfully or persistently violates any rule or whose physical condition is deemed dangerous or offensive to other persons. No person shall fail to leave the library if so ordered. (Ord. 92-9 (part), 1993).

2.45.190 Violations.

Violation of this chapter shall constitute a misdemeanor. (Ord. 92-9 (part), 1993).
