SNOW MACHINES AND OFF-ROAD RECREATIONAL VEHICLES

11.08.010    ATVs permitted on borough streets and roadways.

A.  The operation of snow machines and off-road recreational vehicles on streets and roadways owned and maintained by the borough shall be permitted, subject to the provisions of this chapter.

B.    For the purposes of this chapter, "snow machine" and "off-road recreational vehicle" shall mean a motorized vehicle that is propelled by gasoline, electricity, or any combination of the two, and is designed primarily for the purpose of traveling over unpaved and/or unimproved terrain.  (Ord. 2015-04 (part), 2015).

11.08.020    Snow machine and off-road recreational vehicle operation.

Any snow machine or off-road recreational vehicle operated on streets and roadways owned and maintained by the borough must be operated in compliance with all laws and rules of the road governing the operation of vehicles on those streets and roadways.  (Ord. 2015-04 (part), 2015).

11.08.030    Parental and guardian responsibility.

When a person under the age of eighteen years violates any part of this chapter, his or her parent or guardian is also in violation if:

A.    The parent or guardian knowingly allows the violation to take place; or

B.    The parent or guardian fails to take reasonable precautions to prevent the violation.  (Ord. 2015-04 (part), 2015).

11.08.040    Equipment requirements.

A snow machine or off-road recreational vehicle may only be operated on streets and roadways owned and maintained by the borough if:

A.    It is equipped with at least one functional headlight and taillight.  The headlight and taillight shall remain illuminated at all times that the snow machine or off-road recreational vehicle is being operated on a street or roadway owned and maintained by the borough.

B.    Vehicles not equipped with head- and/or taillights shall not be permitted to operate from dusk until dawn and hours of darkness.

C.    It is equipped with a braking system sufficient to control, slow, and stop the vehicle under normal operating conditions.

D.    Towed equipment must have reflective devices affixed.  (Ord. 2015-04 (part), 2015).

11.08.050    Operation by police and public safety officers.

The provisions of this chapter shall not apply to police officers, public safety officers, fire/rescue personnel, or their agents, during the lawful performance of their official duties.  (Ord. 2015-04 (part), 2015).

11.08.060    Failure to stop at the direction of police or public safety officers.

A.  No person, when operating a snow machine or off-road recreational vehicle on a street or roadway owned and maintained by the borough, shall fail to stop when directed to do so by a police officer or public safety officer.

B.    When used in this section, "direct" means to signal or communicate, either by means of a hand motion, audible mechanical or electronic noise device, visual light device, or any combination, when used in a manner that would cause a reasonable person to understand that the police officer or public safety officer wishes the operator to stop.  (Ord. 2015-04 (part), 2015).

11.08.070    Penalties.

The penalty for violation of any provision of this chapter shall be in accordance with the provisions set forth at Chapter 1.16.010 of this code.  (Ord. 2015-04 (part), 2015).
