19.04.010   Authorized.

The borough shall have the power to provide public facilities and services for harbors, wharves, and other marine facilities, as authorized by Section 29.48.030 of the Alaska Statutes.  (Ord. 76-5 §1, 1976, approved by a vote of the people, April 6, 1976).

19.04.020   Port of Bristol Bay--Created.

There is created a Port of Bristol Bay for the Bristol Bay Borough as an agency of the government.  The executive powers for the Port of Bristol Bay are vested in the borough manager as stipulated in Chapter 2.20.  (Ord. 83-4 §1(part), 1983).

19.04.030  Port of Bristol Bay--Tariffs.1

The borough manager shall prepare for assembly approval a tariff to be applied at the Port of Bristol Bay.  The tariff shall stipulate the fee schedules for all the appropriate uses of the port facility, equipment and surrounding area.  The tariff shall be adopted by the assembly not earlier than fourteen days following its introduction and after seven days of public notice.  Such notice to the public shall be given by posting a notice of the time and place of the assembly meeting at which the tariff is to be considered.  No officer, department or board shall, without prior assembly approval, charge a fee of any amount not specified in the tariff.  (Ord. 83-4 §1(part), 1983).

19.04.040   Port reserve account.

The port reserve account is established to be used for replacing equipment, facilities or any port need.  Funds may be loaned to the general fund as determined by the borough assembly.  The amount to be deposited shall be set in a revised budget, if any, and transferred to the account after the prior year annual audit has been completed and accepted.  The amount transferred shall not include depreciation.  (Ord. 2007-06 §3, 2007).

19.04.060   Violation--Penalty.

Any person violating any of the provisions, or failing to comply with the mandatory requirements, of the tariff ordinance shall be guilty of an infraction and is punishable by a fine not to exceed three hundred dollars.  (See Section 1.16.010.)  (Ord. 84-2 §1(part), 1984; Ord. 83-4 §1(part), 1983).
