2.19.020 Duties.
A. The borough attorney is the legal advisor of the mayor, the assembly, the school board, and the other officers of the borough. He represents the borough as attorney in all civil and criminal proceedings except where the assembly or the school board, in their judgment, may deem independent counsel is needed.
B. The borough attorney shall assist in the development of and provide review of ordinances, resolutions, contracts or other documents for the assembly, borough administration, school district administration and the board of education to ensure competent and proper operation of the borough and school district within the limits of existing ordinances and statutes.
C. The borough attorney shall regularly attend and advise the assembly, school board, platting commission and planning commission meetings.
D. The borough attorney may not file any appeal of any civil action without the consent of the majority of the assembly. (Amended during 1993 republication; Ord. 84-60 § 2, 1984)
2.19.030 Vacancy.
A. The mayor shall provide written notice within 14 days of the vacancy, whether by removal for cause, resignation or other causes, of the borough attorney, to the assembly and set forth criteria for filling the position, with assembly approval.
B. The assembly shall first review and confirm, by majority vote, the selection of the borough attorney. (Ord. 84-60 § 2, 1984)
