FORM OF GOVERNMENT AND GENERAL POWERS

1.08.010 Name of municipality—Form of government.
A. The city of Wasilla shall continue as a municipal corporation under the name: “City of Wasilla.”
B. The government of the city shall be that commonly known and designated as the mayor-council form. (Prior code § 1.08.010)
1.08.020 Municipal powers, facilities and services.
A. The city may exercise any municipal power not otherwise prohibited by law.
B. The city is authorized to provide public facilities and services, which shall include, but not be limited to:
1. Streets, roads, sidewalks, paths and trails, including related water drainage, landscaping and parking;
2. Sewers and sewage treatment;
3. Water treatment and distribution, including fire hydrants;
4. Utility easements;
5. Police protection and jails;
6. Parks, playgrounds, sports fields and recreation;
7. Community centers, libraries, museums, and all other public buildings and grounds;
8. Airports and aviation;
9. Public transportation;
10. Cemeteries;
11. Planning and land use;
12. Housing and urban renewal, rehabilitation and development;
13. Economic and tourism development;
14. Watercourse and flood control;
15. Environmental and wetlands protection;
16. Wildlife conservation and protection; and
17. Any other facility or service deemed necessary or appropriate by the council.
C. The provision of any public facility or service is subject to council approval and the availability of funds.
D. This section is to be broadly interpreted to authorize all acts related to the providing of any public service or facility which the city is not prohibited by law from providing. (Prior code § 1.08.045)
1.08.030 Eminent domain.
The city may exercise the powers of eminent domain and declaration of taking in the performance of an authorized power of function of the city, in accordance with AS 09.55.240 through 09.55.460; provided, that the city may exercise the powers of eminent domain or declaration of taking to acquire property only if the city will own, or if the public will have the legal right to use, the property, and the city may not exercise the powers of eminent domain or declaration of taking to provide property for private economic development. The exercise of the power of eminent domain or declaration of taking shall be by resolution of the council. (Ord. 05-78 § 2, 2005: prior code § 7.08.010)
1.08.040 Adverse possession.
The city cannot be divested of title to real property by adverse possession. (Prior code § 7.08.020)
