8.08.010 Refuse enclosure required.

A.    All commercial and industrial establishments and all multifamily dwellings larger than a duplex must have an on-premises can, receptacle, dumpster or facility which may be used as a point of pick-up or storage for refuse.

B.    Enclosures constructed or furnished to comply with this section shall be closed at all times except during deposit or removal of refuse. Enclosures shall be adequate to prevent access to and the spreading of refuse by animals, wind or other means. (Prior code § 11.12.010)

8.08.020 Unauthorized use.

It is unlawful for any person to deposit refuse into a dumpster, refuse container or refuse enclosure without the express approval of the owner or authorized representative. (Prior code § 11.12.020)

8.08.030 Collection and transportation of refuse.

All refuse shall be collected in a sanitary manner and transported to an approved disposal facility in a covered container. Refuse shall not be permitted to be wind-blown or otherwise distributed from the collector’s property or transporting vehicle. Refuse blown from the collector’s property or spilled during collection or transportation shall be immediately retrieved by the collector or transporter, returned to the collector’s property or vehicle and the area cleaned. Contractual or other arrangements for the removal of accumulated refuse shall not relieve any person of this primary responsibility. (Prior code § 11.12.030)

8.08.040 Litter unlawful.

No person may dispose of garbage, refuse or trash of any kind other than at locations and in the manner designated by the city. (Ord. 00-30 § 3, 2000: prior code § 11.16.010)

8.08.050 Remedies and penalties.

Remedies and penalties for violations of this chapter are as provided in Chapter 1.20. (Ord. 01-47 § 7, 2001)
