4.15.010 Boards established.
There shall be a board for each service area to supervise the furnishing of special services in a service area. The board shall have the powers and duties prescribed in Chapter 4.20 KIBC. [Ord. 98-04 §2, 1998; Ord. 80-29-O §1, 1980].
4.15.020 Composition, appointment, election, qualifications.
A board shall consist of three members, or more, as the assembly may determine by ordinance. The initial members of the board shall be appointed by the assembly to serve until the expiration of their terms as set forth in KIBC 4.15.030. Thereafter, members of the board shall be elected by the qualified voters within the service area at a regular election. Vacancies shall be filled by the candidate(s) receiving the highest number of votes cast for each seat. Each board member shall be qualified to vote within the borough and shall be a resident of the service area. [Ord. 98-04 §2, 1998; Ord. 83-48-O, 1983: Ord. 82-48-O §1, 1982: Ord. 80-29-O §1, 1980].
4.15.030 Term.
Initial members shall be appointed by the mayor and ratified by the assembly until the next regular election; at which time their terms shall be divided substantially into thirds, so as to have terms of one, two and three years, respectively, so the terms of the board members will be staggered. Thereafter, terms will be for three years. [Ord. 83-48-O, 1983].
4.15.040 Vacancies.
A. Vacancies on service area boards, other than by expiration of the member’s term, are created when a member:
1. Fails to qualify or take office within 30 days after election or appointment;
2. Is physically absent from the municipality for 90 consecutive days unless excused by the board, committee, or commission;
3. Resigns and the resignation is accepted;
4. Is physically or mentally unable to perform the duties of office as determined by two-thirds vote of the board;
5. Is convicted of a felony or of an offense involving a violation of the oath of office;
6. No longer physically resides in the municipality and the board, committee, or commission by two-thirds vote declares the seat vacant; this subsection does not apply to a member of the board, committee, or commission who forfeits office under AS 29.20.140(a); or
7. If a member of the board, committee, or commission misses three consecutively held regular meetings and is not excused.
B. If a member of the board, committee, or commission misses one-half of the meetings held in any year of his or her term in office, each year between November 1st and October 31st, the seat shall be automatically vacated.
C. The service area board shall notify the clerk of a vacancy on the board. The clerk shall cause notice thereof to be published at least twice in a newspaper of general circulation within the borough. The notice shall set forth the vacancies and any qualifications of members.
D. The clerk shall provide a standard application form for interested persons to complete. The form, letters or other expressions of interest shall be made to the clerk who shall forward copies to the service area board.
E. The service area board may submit its nomination of a person from the submitted applications to fill the vacancy to the assembly. The assembly shall appoint a new member selected from the submitted applications for the remaining unexpired term. [Ord. FY 2008-15 §3, 2008; Ord. 80-29-O §1, 1980; Ord. 91-04 §2, 1991].
4.15.050 Compensation.
Board members shall be compensated as provided by resolution of the assembly, and shall be reimbursed for reasonable expenses incurred in the performance of their duties. [Ord. 80-29-O §1, 1980].
4.15.060 Officers.
Each board annually shall select from its membership a chair, vice-chair, and secretary. The chair shall preside at meetings of the board, and shall represent the board as directed by its membership. The vice-chair shall act in the absence of the chair. The secretary shall keep minutes of the board’s proceedings. [Ord. 80-29-O §1, 1980].
4.15.070 Meetings, quorum.
A. A board shall hold a regular meeting once a quarter, or more frequently, in accordance with the board’s rules of procedure. The chair or three board members may call a special meeting of their board.
B. A majority of the authorized membership of a board constitutes a quorum. All board actions shall be by vote of a majority of the board’s authorized membership who are qualified to vote on the question under KIBC 2.35.010. [Ord. 80-29-O §1, 1980].
4.15.075 Reports and minutes.
The service area board shall keep minutes of the proceedings, and such minutes shall record the vote of each member upon every question formally presented for consideration. The minutes shall be filed in the office of the clerk and shall be a public record open to inspection by any person. [Ord. 95-02 §2, 1995].
4.15.080 Rules of procedure.
A board may, by resolution, adopt its own written rules of procedure, consistent with this title, governing the conduct of its proceedings. In all matters of procedure not governed by such rules or this title, Robert’s Rules of Order, Newly Revised, shall govern. [Ord. 80-29-O §1, 1980].
4.15.090 Conflict of interest.
