17.40.010 Hardship.

The developer or subdivider may upon written application to the planning and zoning commission request a variance from certain regulations of this chapter. Where the planning and zoning commission finds that hardship may result from strict compliance with these regulations, the commission may recommend to the town council to vary the regulations; provided, that such variations will not have the effect of nullifying the intent and purpose of the general development plan or these regulations. 17.40.020 Large scale development.

The standards and requirements of these regulations may be modified by the commission in the case of a plan and program for a new town, a complete community or a neighborhood unit, which in the judgment of the commission provides adequate public spaces and improvements for circulation, recreation, light, air, and which also provides such covenants or other legal provisions as will assure conformity to and achievement of the plan. 17.40.030 Conditions.

In granting variances or modifications the commission or town council may require such conditions as will, in its judgment, secure substantially the objectives of the standards of requirements so varied and modified. (Ord. 06-07 § 1, 2006; prior code § 13-1-11(C))
