2.60.010 Settlement authority in general.

No settlement of any kind or description, payment of which is to be made from funds of the town or which settlement would result in the town receiving services or compensation less than owed to the town, shall be made by any officer, employee, or agent of the town, except in the manner set forth in this chapter.

A. Whenever any settlement of a claim or lawsuit by or against the town or its employees is for the sum of not more than $100,000, and the actual expense to the town does not exceed $25,000, the town manager shall be authorized to settle the claim, after due consideration of the best interest of the residents of the town, and consultation with the town attorney and risk manager.

B. Whenever any contemplated settlement of a claim or lawsuit by or against the town or its employees is for the sum of more than $100,000, or the actual expense to the town exceeds $25,000, the town council shall be required to approve the settlement. [Ord. 2017-119 § 1.]
