TOWN MAGISTRATE

2.55.010 Town magistrate.

A. Office Established. The office of town magistrate is hereby created and established. The town magistrate shall be appointed from time to time by the town council, for a definite term of not less than two years.

B. Absence of Town Magistrate. In the absence of the town magistrate he or she shall be responsible for the provision of a judge pro tempore to act as the town magistrate during the absence of the magistrate.

C. Compensation. The town magistrate shall receive such compensation as the town council shall fix at the time of appointment of the town magistrate, and said compensation shall be a proper charge against the funds of the town. Additionally, the town council may grant pay raises for the magistrate from time to time.

D. Powers and Duties. The town magistrate shall be the presiding officer of the magistrate court and shall perform those functions necessary to the maintenance of the town magistrate court as provided by state statute and by Chapter 2.110 STC.
