6.10.010 Town code supplementary to other law.
The provisions of this title are in addition to any requirements under United States law, Arizona law, Pima County law and other applicable regulations relating to the licensing of dogs, vaccination, kennel permits and other regulations which are not in conflict with the regulations contained in this title. 6.10.020 License required.
A. All dogs owned, possessed, harbored or maintained in the town for more than 30 days shall be licensed, if over three months of age, in accordance with this chapter. Licenses shall be issued, and fees collected, by the town enforcement agent or approved veterinary clinic or hospital. Licenses shall be good for one year.
B. Before a license is issued, the owner must present a rabies vaccination certificate signed by a veterinarian stating the owner’s name and address and giving each dog’s description, date of vaccination, type, manufacturer, the serial number of the vaccine and the date revaccination is due.
C. The town enforcement agent may apprehend and impound, or cause to be impounded, any dog, required to be licensed, which is found without a license tag for the current year. [Ord. 2005-09 § 1; prior code § 6-2-2.]
6.10.030 License fee.
A. No dog license shall be issued by the town enforcement agent until the payment of a license fee has been made. License fees are as set forth in Chapter 3.10 STC.
B. The annual license fee for any dog declared vicious or dangerous pursuant to this title shall be as set forth in Chapter 3.10 STC.
C. A late penalty as set forth in Chapter 3.10 STC will be charged on payments made after 30 days from the expiration date of the license. If the license is obtained one year or later from the date on which the dog is required to be licensed, an additional penalty fee as set forth in Chapter 3.10 STC shall be paid.
D. Owners of altered dogs wanting to pay lower license fees shall be required to sign an affidavit or present to the town enforcement agent a certificate from a licensed veterinarian stating that a dog has been altered. [Ord. 2008-07 § 11; Ord. 2005-09 § 1; prior code § 6-2-3.]
6.10.040 Violations – Penalty.
The owner of any dog who fails to license such dog pursuant to this chapter is guilty of a class two misdemeanor, which is punishable by a fine of not less than $150.00 nor more than $750.00, four months in jail, two years’ probation, or any combination thereof. No judge may grant probation in lieu of, or otherwise suspend, the imposition of the minimum fine prescribed herein; provided, however, that where a violation of this section is charged, the fine shall be reduced to $75.00 upon a showing to the court of proof of licensing, as is required for such dog, within 15 days of issuance of the complaint.
