SPIRITUOUS LIQUOR ON PARK PREMISES

12.25.010 General.

A. No person shall consume spirituous liquor in town parks or recreation areas, including parking lots and driveways, except that beer and wine may be consumed when the appropriate permit is obtained from the director, consumption remains in compliance with the terms of said permit, and such consumption is in adherence with all state laws. In no case shall the issuance of such permit be construed to grant permission to drink to excess.

B. “Spirituous liquor” includes, but is not limited to, alcohol, brandy, whiskey, rum, tequila, mescal, gin, vodka, mead, wine, port, ale, beer, any malt liquor, malt beverage, absinthe or compound or mixture of any of them, or of any of them with any vegetable or other substances, alcohol bitters, bitters containing alcohol, and any liquid intoxication, fruits preserved in ardent spirits and beverages containing more than one-half of one percent of alcohol by volume. “Beer” means any beverage obtained by the alcoholic fermentation, infusion, or decoction of barley malt, hops, or other ingredients not drinkable, or any combination of them. 12.25.020 Open container.

Notwithstanding STC 12.25.010, it is unlawful for any person to consume or have an open container of any spirituous liquor within parking lots or vehicles within a town park. [Ord. 2001-11; prior code § 15-5-2.]

12.25.030 Exemptions.

The following areas are exempt from this chapter:

A. Town golf courses during established hours of operation. [Ord. 2001-11; prior code § 15-5-3.]

12.25.040 Permits.

The director is empowered to issue permits authorizing the consumption and possession of beer and wine in public parks to individuals as well as event organizers who may obtain such a permit for the attendees of an organized event for which an event permit has been issued. The director is empowered to adopt rules and procedures for the issuance of such permits, in accordance with STC 12.25.010. [Ord. 2001-11; prior code § 15-5-4.]
