12.40.010 Violations of this chapter or regulations.

Unless otherwise indicated herein, any person violating any provision of this chapter or the rules and regulations relating to parks established by the director and filed with the town clerk shall be guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a fine not exceeding $1,000, by imprisonment for not more than six months, by not more than three years probation, or by any combination thereof. In addition, a person convicted of a violation of STC 12.15.030(C) or (D) shall be punished by a fine of not less than $10.00, and no judge may suspend the imposition of this minimum fine. 12.40.020 Permits, licenses and reservations.

Notwithstanding the provisions of STC 12.40.010, a violation of Chapter 12.20 STC shall constitute a misdemeanor punishable by community service or fines not to exceed $250.00, by imprisonment not to exceed 10 days, by probation not to exceed one year, or by any combination thereof. The rate of substitution of community service work for the fine amount shall be calculated at $10.00 per hour. [Ord. 2001-11; prior code § 15-8-2.]

12.40.030 Spirituous liquor on park premises.

A person or corporation who violates any provision of Chapter 12.25 STC is guilty of a class one misdemeanor, punishable by a maximum fine of $2,500, a maximum term of incarceration of six months, and a maximum length of probation of three years. [Ord. 2001-11; prior code § 15-8-3.]

12.40.040 Wasting or abusing athletic facility lighting – Fines and penalties.

A. The person or persons responsible for causing night lighting of any parks and recreation department athletic facility who fails to extinguish the lights after use of the facility is completed shall be subject to the following fines or penalties:

1. First offense: a minimum fine of $20.00.

2. Second offense: a minimum fine of $40.00.

3. Third offense: revocation of the privilege of being able to reserve any athletic facilities for nighttime use for a period of one year.

B. In those parks in the town that have a posted hour of closing, it shall be unlawful to continue to use lighted athletic facilities after the hour of closing; and failure to turn out the lights at any such athletic facility shall subject the individual or individuals utilizing the lights to the following fines or penalties:

1. First offense: a minimum fine of $10.00.

2. Second offense: a minimum fine of $20.00.

3. Third offense: revocation of the privilege of being able to reserve any athletic facilities for nighttime use for a period of one year. [Ord. 2001-11; prior code § 15-8-4.]
