8.24.010 Definitions
As used in this chapter:
"City vehicles" are defined as any enclosed or enclosable vehicles owned or leased by the city and used by or under the direction of city personnel.
"Designation area" means any area owned or occupied by the city which is designated as a "no smoking" area by the city manager.
"Enclosed public place" means any area closed in by roof and walls with openings for ingress and egress, which is owned or occupied by the city, its departments, officers, agents or employees.
"Jail facilities" are defined as the facilities currently owned by the city for the purpose of incarcerating city or state prisoners, either prior to or after sentencing. (Ord. 1129 (part), 2010; Ord. 671 § 1 (part), 1995: Ord. 657 § 1 (part), 1993: prior code § 13-1)
8.24.020 Prohibition Against Smoking in Public Places and in City Vehicles
A. Smoking shall be prohibited in, and such prohibition shall be appropriately posted in, all enclosed public places, designated areas and city vehicles as defined herein.
B. The city shall post "no smoking" signs in prominent locations in all enclosed public places, designated areas and city vehicles governed by this chapter. (Ord. 671 § 1 (part), 1995: Ord. 657 § 1 (part), 1993: prior code § 13-2)
8.24.030 Exceptions
This chapter shall not apply to the jail facilities currently owned by the city. (Ord. 671 § 1 (part), 1995: Ord. 657 § 1 (part), 1993: prior code § 13-3)
8.24.040 Penalty Fees and Enforcement
A. The Winslow police department shall have the authority to enforce compliance with this chapter.
B. Any party found guilty of violating any of the provisions of this chapter shall be found guilty of a Class 3 misdemeanor punishable pursuant to Arizona statutes. Each occurrence or day that a violation continues shall be a separate offense, punishable as described above. (Ord. 671 § 1 (part), 1995: Ord. 657 § 1 (part), 1993: prior code § 13-4)
