(R-2) MULTIPLE-FAMILY RESIDENTIAL ZONING DISTRICT – TWELVE DWELLING UNITS PER ACRE

17.36.010 Purpose.

The principal purpose of this zoning district is to provide for multiple-family housing along with other types of high-density housing in locations which are suitable and appropriate taking into consideration existing conditions, including present use of land, future land use needs, and the availability of public utilities. The minimum lot required is seven thousand (7,000) square feet in area and the maximum allowable density is twelve (12) dwelling units per acre. Principal uses permitted in this zoning district include multiple-family dwellings and other types of high-density housing, orphanages, rest homes, nursing homes and convents. 17.36.020 Use regulations.

A building or premises shall be used only for the following purposes:

A.    Single-family dwellings, excluding mobile homes and manufactured homes;

B.    Churches, subject to securing a conditional use permit;

C.    Private schools with a curriculum the same as customarily given in public schools, subject to securing a conditional use permit;

D.    Service to the public of water, gas, electricity, telephone, telegraph, steam, hot or cold air and sewage including waste water treatment plants, subject to securing a conditional use permit. The foregoing shall be deemed to include attendant facilities and appurtenances to these uses, including, without limitation, distribution, collector and feeder lines, pumping or booster stations along pipelines, and substations along electric transmission lines;

E.    Golf courses including club houses located thereon, but not including miniature courses or practice driving tees operated for commercial purposes, subject to securing a conditional use permit;

F.    Parks, playgrounds, tennis courts and community buildings, provided such uses are conducted on a nonprofit basis;

G.    Home occupation, subject to securing a conditional use permit;

H.    Fences of freestanding walls not to exceed a height of three feet, six (3’6") inches in any required front yard, and not to exceed a height of six (6) feet in the side and rear yards;

I.    Multiple-family dwellings, including townhouses, condominiums, apartments, and two or three-family dwellings ("duplexes" and "triplexes");

J.    Boarding and lodging houses;

K.    Orphanages, rest homes, nursing homes and convents subject to securing a conditional use permit;

L.    Private swimming pools along with incidental installations, such as pumps and filters, provided such pool and incidental installations are screened from adjoining lots by a solid wall or protective fence at least six (6) feet in height, with self-latching gates, and provided such pool sets back from all lot lines in accordance with Section 17.36.040;

M.    Corrals for the keeping of horses, subject to securing a conditional use permit and the requirements of 17.104.160 (Equine Regulations). (Ord. 95-106 (part); Ord. 90-82 § (1)(702)) (Ord. 01-193)

17.36.030 Height regulations.

Building height shall not exceed thirty-five (35) feet in height from grade to the highest point on the roof, unless otherwise provided in Section 17.104.070. (Ord. 90-82 § (1)(703)) (Ord. 99-167, § 1) (Ord. 07-293)

17.36.040 Yard regulations.

The required yards are as follows:

A.    Front Yard.

1.    There shall be a front yard having a depth of not less than twenty (20) feet.

2.    For through lots, a front yard shall be provided along both front lot lines.

3.    Yards along each street side of corner lots shall have a width equal to not less than one-half (1/2) the depth of the required front yard. Yards along each street side of corner lots shall otherwise conform with regulations applicable to front yard.

B.    Side Yard. There shall be a side yard on each side of a building having a width of not less than five (5) feet.

C.    Rear Yard. There shall be a rear yard having a depth of not less than fifteen (15) feet, or, in the case of a legally recorded undersized lot or parcel fifteen (15%) percent of the total lot depth. (Ord. 90-82 § (1)(704))

17.36.050 Intensity of use regulations.

The intensity of use regulations are as follows:

A.    Lot Area. Each lot shall have a minimum lot area of seven thousand (7,000) square feet.

B.    Lot Width. Each lot shall have a minimum width of seventy (70) feet.

C.    Building Area. The minimum building footprint for all residential structures in a multifamily development shall be one-thousand (1,000) square feet.

D.    Density. The maximum allowable density is twelve (12) dwelling units per acre.

E.    Lot Coverage. The maximum lot coverage shall be fifty (50%) percent of the lot area.

F.    Distance Between Buildings. The minimum distance between buildings on the same lot shall be ten (10) feet. (Ord. 90-82 § (1)(705))

G.    Townhouses

1.    Lot Size. Townhouse lots shall have no minimum lot area or width.

2.    Lot Coverage. Townhouse developments shall have no lot coverage requirements.

3.    Density. The maximum allowable density is twelve (12) dwelling units per acre.

4.    Distance Between Buildings. The minimum distance between buildings on the same lot shall be ten (10) feet. (Ord. 90-82 § (1)(705)).

5.    All townhouse developments will be treated as subdivisions, and are subject to regulation under Chapter 16.04, Subdivision Regulations.
