3.28.010 Report preparation Department designation.

Each year on or before July 15th the board of supervisors shall cause to be prepared a written report, by the county auditor, which shall contain a description of each parcel of real property within County Service Area No. 1 establishing the assessment charges for the right to dump solid waste at Red Hill disposal site in Calaveras County (Ord. 446 § 1, 1984)

3.28.020 Assessment computation procedure.

A. Each year on or before July 1st the county auditor shall obtain the fiscal year assessment charges from the Calaveras County public works department.

B. Each year on or before July 1st the county assessor shall furnish to the auditor a copy of the secured and unsecured assessment rolls for the fiscal year designating all improved and unimproved property within the boundaries of County Service Area No. 1.

C. The auditor shall compute the assessment rates for all property pursuant to Resolution 82-47 outlined as follows:

1. Full rate for all improved parcels;

2. One-half rate for unimproved parcels and Lake Alpine summer homes in the County Service Area No. 1.

D. Upon completion of the computations the auditor shall compile the report which will include the designated assessment roll and file said report with the clerk to the board of supervisors on or before August 1st. (Ord. 446 § 2, 1984)

3.28.030 Notice of hearing.

Upon the filing of such report, the clerk shall fix a time, date and place for hearing thereon and for filing objections or protests thereto. The clerk shall publish notice of such hearing as provided in Section 6066, prior to the date set for hearing, in a newspaper of general circulation printed and published in the county, and post the notices of hearing in three places within County Service Area No. 1. 3.28.040 Hearing and confirmation of report.

At the time, date, and place stated in the notice, the board of supervisors shall hear and consider all objections or protests, if any, to the report and may continue the hearing from time to time. Upon conclusion of the hearing, the board of supervisors may adopt, revise, change, reduce or modify any charge and shall make its determination upon each charge as described in the report and thereafter, by resolution, shall confirm the report, setting the rates to be levied.

The resolution shall be transmitted to the county auditor on or before September 1st. (Ord. 446 § 4, 1984)

3.28.050 Collection of assessment fees.

A. The charges set forth in the report and confirmed by the board of supervisors resolution shall appear as a separate item on the tax bill. The charges shall be collected at the same time and in the same manner as ordinary county ad valorem property taxes are collected for all secured property and shall be collected at the same time and in the same manner as ordinary county ad valorem property taxes as collected for all unsecured property in the next tax collection cycle.

B. All fees shall be subject to the same penalties and same procedure and sale in case of delinquency as provided for such taxes. All laws applicable to the levy, collection, and enforcement of county ad valorem property taxes shall be applicable to such charge; except that, if for the first year such charge is levied the real property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has been created and attached thereon, prior to the date on which the first installment of such taxes would become delinquent, the charge confirmed pursuant to this section shall not result in a lien against such real property but instead shall be transferred to the unsecured roll for collection.
