18.78.010 Purpose and applicability.

A. The purpose of this section is to establish a permit procedure for public or private events that may require regulation to insure public health, welfare and safety in regard to sanitation, traffic control, police protection, environmental protection and aesthetics.

B. This chapter shall apply to any event that involves a group of seventy-five or more people, either as participants or spectators, or which proposes use of signs not regulated by other chapters of this code.

C. Exemptions to this section shall include events using county facilities within their normal capacity and private wedding, birthday or similar celebrations which do not have potential to impact public health, welfare and safety as determined by the county planner. (Ord. 590 § 1 (part), 1996)

18.78.020 Permit required.

No person shall operate any special event within the unincorporated boundary of Alpine County without first obtaining a special event permit as hereinafter required. (Ord. 590 § 1 (part), 1996)

18.78.030 Application and fees.

A. Application for a special event permit shall be filed at least fourteen days prior to the date of the proposed event or sixty days prior to any event determined by the county planner to be a major event requiring public notice. The county planner may, in his discretion, waive the requirement that applications be filed fourteen days prior to the date of the proposed event.

B. Applications shall be filed on forms provided by the Alpine County planning department, together with an application processing fee as established by resolution of the Alpine County board of supervisors. (Ord. 590 § 1 (part), 1996)

18.78.040 Processing procedure.

A. Upon receiving application for a special event permit, the county planner may issue a special event permit provided the following criteria are met:

1. The special event will not exceed five consecutive days in any ninety-day period.

2. The property owner has provided written authorization for use of the site.

3. A site plan has been approved by the county health, fire, sheriff, building and public works departments when referred by the county planner.

4. The event is in compliance with all applicable county ordinances.

B. The county planner shall require conditions to be met to protect health, safety and welfare including, but not limited to:

1. Liability insurance of one million dollars;

2. Insurance certificate naming Alpine County, its officers, agents and employees as additional insured;

3. Indemnification of Alpine County and all officers and employees from all costs and claims for damages to real and personal property or personal injury to any party resulting from the event;

4. Cash deposit to ensure site and right-of-way restoration.

C. The county planner shall refer major events including over five hundred participants to the planning commission for public hearing and decision. (Ord. 649 § 1 (part), 2003; Ord. 590 § 1 (part), 1996)

18.78.050 Revocation.

The county sheriff may revoke any permit issued under the provisions of this chapter on any of the following grounds:

A. The permittee has ceased to meet any of the requirements for issuance of a permit;

B. The special event has been operated in an illegal or disorderly manner as defined by California Penal Code Section 415, or in violation of any applicable federal, state or municipal law or regulation;

C. The conduct of such special event unduly interferes with traffic or pedestrian movement, or interferes with the public peace or rights of nearby residents, or with the enjoyment of their property. (Ord. 590 § 1 (part), 1996)

18.78.060 Appeal.

All determinations made by the county planner under this chapter are subject to appeal according to provisions of Chapter 18.88 of this code. (Ord. 590 § 1 (part), 1996)
