CHAPTER 4—REGULATIONS FOR USE OF THE ALDERGROVE MARSH

Sec. 10700 Access generally. (Ord. 1193, eff. 7/31/1992)

Access to all wetland portions of the site will be restricted from public use unless specifically authorized by the Director of Environmental Services or his designee.

Sec. 10705 Motorized vehicles.

Motorized vehicles will be restricted to the Alder Grove Road parking lots only. Parking will be only allowed in designated parking areas.

Sec. 10710 Hunting.

No hunting will be allowed at any time.

Sec. 10715 Leash law.

The Arcata leash law for animals will be strictly enforced at the site.

Sec. 10720 Access. (Ord. 1193, eff. 7/31/1992)

Access to the east, west, and north dikes of the Marsh will be prohibited from public use unless specifically authorized by the Director of Environmental Services or his designee.

Sec. 10725 Air space.

The air space above the Marsh will be restricted to the heights established by the Federal Aviation Authority. Restrictions include the use of hang gliders, kites, and model airplanes.

Sec. 10730 Horses.

No horses will be allowed at any time.

Sec. 10735 Camping.

The entire site will be closed from one hour after sunset to one hour before sunrise, unless specifically authorized by the Director of Environmental Services or his designee. No overnight camping allowed.

Sec. 10740 Model boats.

No motorized model boats will be allowed.

Sec. 10745 Boats generally.

Boats, unless specifically authorized by the Director of Environmental Services or his designee, will not be allowed in the Marsh.

Sec. 10750 Fishing.

Fishing is restricted to the south dike of the Marsh only. The Marsh will be closed to all fishing during the months of March and April to protect the spawning of native cutthroat trout. Fishing during the remainder of the year requires a California Sport Fishing License and follows California Sport Fishing Regulations.

Sec. 10755 Trees.

Trees and shrubs to be planted must be on the approved list and in the areas designated for planting by the Wetlands and Creeks Advisory Committee.

Sec. 10756 Release of Animals. (Ord. No. 1282, eff. 6/5/1998)

A.    The City Council finds that the presence of non-native animals in the Aldergrove Marsh disrupts the native ecology of that environment. The presence of non-native species is due in part to their release by people.

B.    It shall be unlawful to release or cause the release of any animal into the Aldergrove Marsh, except when specifically authorized by the Director of Environmental Services.

C.    It shall be unlawful to release, or cause the release of, any animal into any area adjoining or in such proximity of the Aldergrove Marsh such that said animal could reasonably be expected to migrate into the Aldergrove Marsh.

D.    The Director of Environmental Services, or his designee, is authorized to impound and remove all non-native animals found in the Aldergrove Marsh. The Director, or his/her designee, shall deliver the impounded animals to the Sequoia Humane Society for processing in accordance with the internal procedures of the Humane Society.
