1.20.010 Authority to enforce.
The city council shall have the authority to enforce the resolutions and ordinances set forth in this code as part of its police powers. (Ord. 387 § 1, 1981)
1.20.020 Violations deemed nuisance.
In addition to the penalties provided for in this chapter, any condition caused or permitted to exist in violation of any of the provisions of this code shall be deemed a nuisance and subject to abatement by the town, pursuant to Section 8.20.070 et seq. of this code, and each day such condition continues shall be regarded as a new and separate offense. 1.20.030 Violation—Abatement.
Each violation of this code shall be a misdemeanor and punishable as provided herein, provided that in the interests of justice the city attorney may charge and prosecute any violation as an infraction which shall be punishable as provided. (Ord. 490 § 3, 1996: Ord. 387 § 3, 1981)
1.20.040 Penalty—Misdemeanor.
Each misdemeanor shall be punishable by imprisonment in the county jail for not to exceed six months, or by fine not exceeding one thousand dollars, or by such fine and imprisonment. (Ord. 490 § 4, 1996: Ord. 387 § 4, 1981)
1.20.050 Penalty—Infraction.
Each infraction shall be punishable by (1) a fine not exceeding one hundred dollars for a first violation; (2) a fine not exceeding two hundred dollars for a second violation of the same ordinance within one year; (3) a fine not exceeding five hundred dollars for each additional violation of the same ordinance within one year. 1.20.055 Administrative and abatement costs.
Whenever a violation of this code is found to exist as a result of an inspection, the reasonable administrative expenses as determined by the city council and actual abatement costs as set by city council resolution, shall be paid by the property owner. The city council shall, from time to time, determine and fix an amount to be assessed as administrative expenses and abatement costs for violations of this chapter. (Ord. 490 § 6, 1996)
1.20.060 Arresting officer defined.
For the purposes of this section, the terms “arresting officer” and “officer” mean any policeman of the town, the chief of police or any official of the town who is charged with the enforcement of the town ordinance in question, or the city manager. (Ord. 387 § 6, 1981)
1.20.070 Liability of officers.
No provision of this code, designating the duties of any officer or employee, shall be so construed as to make such officer or employee liable for any fine or penalty provided for a failure to perform such duty, unless the intent of the council to impose such fine or penalty on such officer or employee is specifically and clearly expressed in the section creating the duty.
