8.48.010 Findings.
A. Numerous studies have found that tobacco smoke is a major contributor to indoor air pollution and breathing secondhand smoke is a significant health hazard for many, especially those individuals with cardiovascular disease, impaired respiratory function and allergies.
B. Health hazards induced by breathing sidestream or secondhand smoke include lung cancer, respiratory infection, decreased exercise tolerance, decreased respiratory function, bronchoconstriction and bronchospasm. Nonsmokers with allergies, respiratory diseases and those who suffer other ill effects of breathing sidestream or secondhand smoke may experience a loss of job productivity or may be forced to take periodic sick leave because of adverse reactions to same.
C. The smoking of tobacco, or any other weed or plant, is a danger to health.
D. The health, safety and general welfare of persons employed by the town and persons who frequent the town’s offices would be benefitted by the regulation of smoking in town offices. (Ord. 439 § 1, 1988)
8.48.020 Smoking prohibited where.
Smoking will not be permitted in any town office. The town offices include the following:
A. All offices, rooms, foyers, hallways, restrooms, storage rooms, and evidence room of the police department;
B. All offices, rooms, foyers, hallways, restrooms and storage rooms of the town administrative offices;
C. All rooms, hallways, restrooms, and storage rooms of the Town Hall;
D. All offices, rooms, restrooms, and storage rooms of the street maintenance department;
E. All offices, restrooms, garden club library, history room, and storage rooms in the Main House at Holbrook Palmer Park;
F. All restrooms and storage rooms in the Creative Design Building and Jennings Pavilion at Holbrook Palmer Park;
G. All rooms, hallways, and storage rooms of the water tower, the carriage house and maintenance shed at Holbrook Palmer Park;
H. All areas where smoking is already prohibited because of the storage or use of hazardous or sensitive materials. (Ord. 439 § 2, 1988)
8.48.030 Smoking permitted where.
Smoking will be permitted only in town vehicles assigned to an individual on a permanent basis. In the event a nonsmoking town employee is a passenger in the vehicle, the vehicle will be considered nonsmoking. All other town vehicles will be nonsmoking vehicles. (Ord. 439 § 3, 1988)
