10.12.010 Purpose.

This chapter is for the immediate preservation of the public peace, health and safety. A declaration of the facts constituting such urgency is as follows: There has recently been a great increase in traffic within the town on the streets described in this chapter causing serious congestion and increased traffic hazards at frequent intervals during each day and week. Nearby municipalities have or are in the process of restricting use of their streets by heavy and commercial vehicles, as a result of which a heavy additional traffic burden is imposed upon the streets designated in this chapter within the town. 10.12.020 Restricted streets designated.

There is prohibited within the town the use of the following described streets by any vehicle exceeding a maximum gross weight limit of three tons, except with respect to any vehicle which is subject to the provisions of Sections 1031 to 1036, inclusive, of the Public Utilities Code of the state:

A. All of the Middlefield Road except the portion thereof extending between Ringwood Avenue and Ravenswood Avenue;

B. Atherton Avenue;

C. Alameda de las Pulgas;

D. Fair Oaks Lane;

E. Marsh Road;

F. Watkins Avenue;

G. Selby Lane;

H. Glenwood Avenue;

I. Oak Grove Avenue;

J. Stockbridge Avenue;

K. Valparaiso Avenue;

L. Camino al Lago;

10.12.030 Signposting.

This chapter shall be effective when appropriate signs are erected indicating the streets affected by this chapter. It is determined that such signs will best serve to give notice of this chapter. (Ord. 259 § 2(b), 1963)

10.12.040 Pick-up, delivery and construction uses permitted.

This chapter shall not prohibit any vehicle coming from an unrestricted street having ingress and egress by direct route to and from a restricted street when necesary for the purpose of making pick-ups or deliveries of goods, wares and merchandise from or to any building or structure located on the restricted street or for the purpose of delivering materials to be used in the actual and bona fide repair, alteration, remodeling or construction of any building or structure upon the restricted street for which a building permit has previously been obtained. 10.12.050 Exempt vehicles.

A. This chapter shall not apply to any vehicle owned by a public utility or a licensed contractor while necessarily in use in the construction, installation or repair of any public utility.

B. This chapter shall not apply to any vehicle when used for purposes directly related to the use, enjoyment, care, improvement or maintenance of any real property within the town or accessible to vehicles only through one or more of the restricted streets.

C. This chapter shall not apply to any authorized emergency vehicle. (Ord. 259 §§ 4—6, 1963)

10.12.060 Designation of additional restricted streets.

Whenever any resolution of the council designates and describes any additional street or portion thereof as a street, the use of which is prohibited by any vehicle exceeding a maximum gross weight limit of three tons, the chief of police shall erect and maintain appropriate signs on those streets affected by such resolution and this chapter. Those streets and parts of streets established by such resolution are declared to be streets, the use of which is prohibited by any vehicle exceeding a maximum gross weight limit of three tons. All other provisions and exceptions in this chapter shall apply to such streets in the same manner as if they had been designated in this chapter. (Ord. 259 § 7, 1963)

10.12.070 Removal of restriction.

Whenever any resolution of the council designates and describes any street or portion thereof (theretofore designated as a street or portion thereof the use of which is prohibited by any vehicle exceeding the maximum gross weight limit of three tons) as a street or a portion thereof, the use of which is no longer prohibited under this chapter, the prohibitions of this chapter shall no longer apply to such street or portion. 10.12.080 Restriction of commercial vehicles.

Whenever any resolution of the council declares that all commercial vehicles shall be subject to the prohibitions of this chapter, the chief of police shall erect appropriate signs indicating the streets and vehicles affected, and thereupon and thereafter the prohibitions, exceptions and all other provisions of this chapter shall be applicable to any commercial vehicle in addition to any vehicle exceeding a maximum gross weight limit of three tons. 10.12.090 Vehicle Code definitions.

Whenever any words or phrases used in this chapter are not defined but are defined in the Vehicle Code of the state and amendments thereto, such definitions shall apply. (Ord. 259 § 10, 1963)
