10.36.010 Definitions.
As used in this chapter:
A. “Atherton resident” means a person who actually resides and lives within the town of Atherton, whether as owner, lessee or occupant of property within such boundaries, or an employee actually living on premises in Atherton.
B. “Atherton resident parking permit” means an identification tag issued to an Atherton resident by the police department for the purpose of permitting parking within the designated vehicle parking lot.
C. “Nonresident” means a person who does not reside and live within the boundaries of the town.
D. “Nonresident parking permit” means an identification tag issued to a nonresident by the police department for the purpose of permitting parking within the designated vehicle parking lot. (Ord. 400 § 2, 1983)
10.36.020 Established.
The property owned in part and leased in part by the town, situated in the town, located west of Station Lane and west of the Southern Pacific railroad tracks and south of Fair Oaks Lane and north of Maple Avenue, which has not been dedicated to any special public use, is established as a parking lot for vehicles. (Ord. 400 § 1, 1983)
10.36.030 Regulations.
A. The town reserves the right to refuse any person or persons the privilege of using the parking area, and further reserves the right at any time to remove a part or all of the parking area for other municipal purposes or to reserve a portion thereof for official vehicles owned by the town or employees of the town.
B. Any person who desires to park in the parking lot area must first obtain an Atherton parking permit from the police department of the town authorizing such parking, which permit must be attached to the windshield of the vehicle. It is unlawful for any person to park a vehicle in the parking lot area unless the vehicle bears a valid parking permit. The issuance of a parking permit shall not constitute a warranty that there will be sufficient space for parking in the area, and the permit is issued conditional upon there being space available.
C. It is unlawful for any person to obtain an Atherton resident parking permit permitting such parking and permit it to be attached to a vehicle operated and parked in the parking area by a person who is not a resident of the town.
D. No vehicle may be left standing in the parking area for a continuous period in excess of one hundred twenty hours. Any vehicle found to have been left standing in the parking area in excess of one hundred twenty hours shall be removed at the owner’s expense. (Ord. 427 § 1, 1987; Ord. 400 § 3(A—D), 1983)
10.36.040 Fee schedule.
A. Resident parking permit, no cost. Permit expires when resident/owner is no longer eligible under Section 10.36.010A of this chapter.
B. Nonresident parking permit, thirty dollars for a three-month permit; fifty cents for a one-day permit.
C. All future fee schedule revisions shall be made by resolution of the city council. (Ord. 400 § 4, 1983)
