12.12.010 Required when.

Where a private driveway leading from private property to, and connecting with, any public street in the town, crosses and passes over and above a gutter or drainage ditch along the side of such street, the owner of the property from which such private driveway leads, shall, at his own cost and expense, install and construct under the driveway where the same crosses and passes over and above such street gutter or drainage ditch, a culvert which, in the opinion of the city engineer, will be of adequate capacity to carry the water which flows therein during the winter season. 12.12.020 Reconstruction of existing culverts.

Any existing culvert under any such private driveway which, in the opinion of the city engineer, obstructs the free flow of water in the gutter or drainage ditch of any public street shall, upon the order of the superintendent of streets of the town, be reconstructed by the owner of the property from which the driveway leads, at his own cost and expense, and to the entire satisfaction and approval of the city engineer. 12.12.030 Construction standards.

Every culvert required under the provisions of this chapter shall be of standard construction and of such diameter and length, as shall be approved by the city engineer, and shall be laid to line and grade established, or to be established, by the engineer and shall be installed and constructed to his entire satisfaction and approval. (Ord. 132 § 3, 1941)

12.12.040 Notice to owner to comply.

Where no culvert has been constructed under a private driveway, as required by this chapter, or where an existing culvert under such driveway is, in the opinion of the city engineer, inadequate in capacity, or does not conform with the requirements of this chapter, it shall be the duty of the superintendent of streets to notify, in writing, the owner of the property from which such private driveway leads to immediately construct and install under such driveway a culvert which shall comply in all respects with the requirements set forth in this chapter, and such owner shall, within ten days after receiving such notice, proceed at his own cost and expense to install and construct an adequate culvert under such driveway in compliance with the provisions of Section 12.12.030 of this chapter, and to the entire satisfaction of the city engineer.
