DENIAL OF PERMITS OR APPROVALS IF PROPERTY ALREADY VIOLATES CODE

8.36.010 Prohibition against granting permits.

All departments, commissions, councils, officials and public employees of the city who are vested with the duty or authority to issue and/or approve permits, licenses or other approvals pursuant to the provisions of this code may withhold the approval and/or issuance of such permits, licenses or approvals where a violation of this code exists on or with respect to the parcel or land for which such license, permit or approval is sought. Licenses, permits and/or approvals which may be withheld include, but are not limited to, building permits, zoning clearance on building permits, certificates of occupancy, business licenses, conditional use permits, precise development plans, variances, lot line adjustments, subdivisions, and rezonings. When the applicable violation(s) has/have been physically abated or otherwise eliminated, permits, licenses or approvals withheld pursuant to this section may be released or granted if otherwise appropriate. Approval of any discretionary permit may be conditioned upon the physical abatement or elimination of a violation of this code. (Ord. 91-4 N.S. § 1, 1991).
