2.10.010 Meetings – Time.

The regular meetings of the city council of the city of Biggs shall be held on the second Tuesday of each month and at such other times during each year as may be provided by law; provided, however, that when the time of regular meeting as aforesaid shall fall on a legal holiday, then such regular day of meeting shall be the next following nonholiday weekday. The standard hour of commencing said meetings shall be 5:00 p.m. of said day of meeting. However, the hour of commencement may be modified for a particular meeting as appropriate. 2.10.020 Meetings – Location.

The place of holding said meetings shall be in the City Council Chamber of the City Hall Annex, located at 3016 Sixth Street in said city of Biggs, unless designated elsewhere by the city council. [Ord. 356 § 1, 2005; Ord. 340 § 4, 2003; Ord. 48 § 2, 1919]

2.10.030 Salary.

Pursuant to Government Code Section 36516, the salary for service upon the city council of the city of Biggs shall be $300.00 per month; provided, that pursuant to Government Code Section 36516.5, the effective date of such salary shall be January 1, 2001. [Ord. 324, 2000]

2.10.040 Filling of council vacancy.

In the event of a vacancy on the city council, for whatever reason, the council shall, within 30 days from the commencement of the vacancy, call a special election to fill the vacancy. The special election shall be held on the date of the next regularly established election or regularly scheduled municipal election to be held throughout the city, not less than 114 days from the call of the special election, as determined by the council. Within 30 days of the vacancy, the council shall also meet to consider an appointment to fill the vacancy; provided, however, that the council retains the discretion to decline any appointment. In the event there is no appointment, the position will remain vacant until the special election. Any person appointed to fill the vacancy holds office only until the date of a special election. 2.10.050 City councilmember attendance and participation protocol.

(1) If a city councilmember is absent without permission from all regular city council meetings for 70 days consecutively from the last regular meeting he or she attended, his or her office becomes vacant and shall be filled as any other vacancy. Government Code Section 36513.

(2) If a city councilmember is absent without permission from four city council meetings, whether regular or special meetings, during any 12-month period, at the next regular council meeting following the fourth such absence, the council shall consider an agenda item providing for the council’s discussion of the following actions as to that city councilmember:

(a) Removal of that councilmember from city assigned or appointed committees, boards and commissions to which that city councilmember had been assigned or appointed.

(b) Preparation of a resolution of disapproval.

(3) If a city councilmember is absent without permission from two consecutive meetings of committees, boards or commissions to which the city councilmember is assigned or appointed, at the next regular council meeting following the second such absence, the council shall consider an agenda item providing for the council’s discussion of the following actions as to that city councilmember:

(a) Removal of that councilmember from city appointed committees, boards or commissions to which the councilmember has been assigned or appointed.

(b) Preparation of a resolution of disapproval.

(4) If a city councilmember is absent without permission from four meetings of committees, boards or commissions to which the city councilmember is assigned or appointed during any 12-month period, at the next regular city council meeting following the fourth such absence, the council shall consider an agenda item providing for the council’s discussion of the following actions as to that city councilmember:

(a) Removal of that councilmember from city appointed committees, boards and commissions to which the councilmember has been assigned or appointed.

(b) Preparation of a resolution of disapproval.

(5) The city clerk shall provide this city councilmember attendance and participation protocol to all city council candidates. [Ord. 419 § 3, 2019]
