2.17.010 City organization – Established by city council.

After obtaining and considering the recommendations of the city administrator, the council shall provide for the organization, functions, conduct and operation of the several offices, departments and commissions of the city, and may provide for the creation of additional offices, departments and commissions from time to time and for their consolidation, alteration, abolition or reassignment. 2.17.020 Contractual services.

The council may, whenever it deems it appropriate and in the public interest, provide for the conduct of a city function or service by contract with another public entity or a qualified private firm or individual. [Ord. 344 § 3, 2003]

2.17.030 City administrator.

The city administrator shall be the chief executive officer of the city government and shall be responsible to the city council for the administration of all units of the city government and for carrying out the policies adopted by the council. The city administrator shall be charged with the preservation of the public peace, welfare, health, the safety of persons and property, the enforcement of law and the development and utilization of the city’s resources.

The city administrator shall:

(1) Appoint, evaluate, discipline and remove, subject to any personnel system policies and procedures approved by the council, all employees of the city. The city administrator may authorize the head of any department or office of the city to appoint, evaluate, discipline or remove subordinates in such department or office;

(2) Prepare the city’s budget annually, submit it to the council and be responsible for its administration after adoption;

(3) Prepare and submit to the council as of the end of each fiscal year a complete report on the finances, physical inventory and administrative activities of the city for such fiscal year;

(4) Keep the council advised of the financial condition and future needs of the city and make such recommendations on any matter as he or she may deem advisable;

(5) Attend all meetings of the council and advise the council as appropriate upon matters coming before it for consideration and action;

(6) Perform such other duties as may be prescribed by law or required of the city administrator by the council. [Ord. 344 § 3, 2003]

2.17.040 City clerk.

The city clerk shall:

(1) Attend meetings of the council and be responsible for the recording and maintaining of a full and true record of all proceedings of the council in books that shall bear appropriate title and be devoted to such purpose;

(2) Call the roll of the council and record the councilmembers present, absent or excused;

(3) Maintain books in which shall be recorded respectively all duly adopted ordinances and resolutions and provide for their publication or posting, as may be appropriate;

(4) Maintain books in which a record shall be made of all written contracts and official bonds;

(5) Be custodian of the seal of the city;

(6) Administer oaths or affirmations, take affidavits and depositions pertaining to the affairs of the city as required and certify copies of official records;

(7) Have charge of all elections to be conducted by the city; provided, that the city may contract with the county of Butte or any public officer authorized to conduct elections for the performance of all duties of conducting such elections;

(8) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.050 City attorney.

The city attorney shall be an attorney at law, duly admitted to practice by the Supreme Court of the state of California and licensed by the state to practice law. He or she shall have been engaged in the practice of law in the state for a period of not less than five years immediately prior to appointment and such practice shall have included knowledge and experience in the practice of municipal law.

The city attorney shall:

(1) Represent and advise the city council, city officers and employees, commissions and committees in all matters of law pertaining to their duties and responsibilities;

(2) Represent and appear for the city in any or all actions or proceedings in which the city is concerned or is a party and represent and appear for any city officer, commission, or employee, or former city officer, commission, or employee in any or all actions and proceedings in which any such officer, commission or employee is concerned or is a party arising out of any act or omission committed in the course and scope of their employment or the performance of the official duties of such officer, commission or employee;

(3) Attend meetings of the city council and give advice or render opinions in writing whenever requested to do so by the city council, or by any of the boards, commissions or officers of the city; provided, that the city attorney may require such requests to be submitted in writing;

(4) Approve the form of all contracts made by and all bonds given to the city, endorsing such contracts or bonds with such approval;

(5) Prepare or approve any and all proposed ordinances or resolutions and any and all amendments thereto;

(6) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.060 City engineer.

The city engineer shall be a registered civil engineer in the state of California and shall have at least five years’ prior experience in municipal engineering.

The city engineer shall:

(1) Establish the grades of all public streets, boulevards, parkways and alleys;

(2) Supervise all engineering, construction and reconstruction work undertaken by the city;

(3) Prepare or oversee the preparation of all plans and specifications for public facilities improvements;

(4) Provide general oversight and supervision to public works personnel in their maintenance of public facilities;

(5) Make and keep map records of all public facilities located in public rights-of-way;

(6) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.070 City planner.

The city planner is responsible for providing professional and technical advice and assistance to the planning commission and the city council on matters relating to planning, zoning, environmental review, development regulatory policies and procedures, annexation and related fields.

The city planner shall:

(1) Enforce city land use regulations, including the general plan, zoning ordinance, subdivision ordinance and code enforcement;

(2) Prepare planning commission agenda, minutes, staff reports and recommendations;

(3) Review building permits and development plans for compliance with applicable land use regulations;

(4) Periodically review and provide recommendations for updating the general plan, zoning ordinance, subdivision ordinance, development standards and related land use regulations;

(5) Administer and supervise planning-related consulting services contracts;

(6) Perform such other duties as may be required by the planning commission, the city council or by law. [Ord. 344 § 3, 2003]

2.17.080 Electric department.

Under the supervision and direction of the city administrator, the electric department shall:

(1) Purchase and distribute all electrical energy required by end users of the city’s electrical system;

(2) Operate and maintain all of the city’s electrical system facilities;

(3) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.090 Finance director.

The finance director shall have a degree in accounting, business administration, public administration or a related field and have at least three years of increasingly responsible experience in accounting, auditing, public finance, public administration or a related field.

The finance director shall:

(1) Be responsible for the administration of the financial affairs of the city;

(2) Have custody of all public funds belonging to the city or to any office, department, commission or committee of the city and administer all such funds in compliance with the provisions of the Constitution and laws of the state of California governing the collection, handling, depositing, investment and securing of public funds;

(3) Submit to the council through the city administrator monthly statements of receipts, disbursements and balances of city funds in such form as to show clearly and completely the financial condition of the city;

(4) At the end of each fiscal year submit a complete and detailed financial statement;

(5) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.100 Fire department.

Under the supervision and direction of the fire chief, the fire department shall:

(1) Protect life and property by preventing and eliminating fire hazards and controlling and extinguishing fires;

(2) Enforce laws and ordinances relating to the preventing and extinguishing of fires and handling of potentially dangerous combustibles, hazardous materials and explosives;

(3) Investigate and report to the police department all cases where there is reason to believe that any fire is the result of a crime or that a crime has been committed in connection therewith;

(4) Maintain in efficient operable condition all fire fighting and fire prevention systems, facilities and equipment assigned to the fire department;

(5) Train all departmental personnel in fire prevention and fire fighting practices and procedures;

(6) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.110 Police department.

Under the supervision and direction of the chief of police, the police department shall:

(1) Prevent crime and maintain law and order in the city by enforcing the laws of the United States, the state of California and the city, except when such enforcement is vested by law in another office or officer;

(2) Maintain in efficient operable condition those crime prevention and law enforcement systems, facilities and equipment assigned to the police department;

(3) Train all departmental personnel in crime prevention and law enforcement practices and procedures;

(4) Serve subpoenas duly and properly issued in the name of the city and attested to by the city clerk compelling attendance of witnesses before the council or any commission, committee or officer of the city;

(5) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]

2.17.120 Public works department.

Under the supervision and direction of the city administrator, with technical assistance provided by the city engineer as required, the public works department shall:

(1) Operate and maintain all city facilities located in public rights-of-way or other city properties;

(2) Operate and maintain the city’s water system;

(3) Operate and maintain the city’s water pollution control system and wastewater treatment facilities;

(4) Perform such other duties as may be required by the council or by law. [Ord. 344 § 3, 2003]
