7.25.010 Discharging – Prohibited.

It shall be unlawful for any person within the corporate limits of the city of Biggs to discharge or explode any firearms, air rifles, air pistols, C.O.2 pistols, C.O.2 rifles, pellet guns, spring guns, bow and arrows, crossbows, slingshots, or other similar gas-actuated rifles or pistols, firecrackers, fire rockets, roman candles, chasers, bombs, cherry bombs, or other fireworks of every kind and description. 7.25.020 Discharging – Peace officer exemption.

Duly constituted peace officers, as particularly described in the Penal Code, shall be permitted to discharge their firearms when necessary and reasonable in the discharge of their official duty. This exception shall not apply to a peace officer who is off duty unless it is determined that he was reasonably performing his official function as a peace officer at the time of the discharge of the firearm. 7.25.030 Discharging – Wildlife control.

(1) If deemed reasonable and necessary by the police department, or by the city council should the police department turn down the request, a permit can be issued for the discharge of the above prohibited devices as authorized by the state of California Fish and Game Department or by the United States Fish and Wildlife Service to disperse or destroy birds and other wildlife which constitute a nuisance or menace to citizens within the corporate limits of the city of Biggs, or constitutes a threat to their health or safety.

(2) Further, the city police or the city council of the city of Biggs can authorize the discharge of devices prohibited herein if deemed necessary for the dispersal and/or capture and/or destruction of any domesticated birds or animals when said domesticated birds or animals constitute a nuisance or menace to citizens within the corporate limits of the city of Biggs, or constitutes a threat to their health or safety. 7.25.040 Holiday fireworks permits.

Further, the city council of the city of Biggs can issue a permit for the discharge of fireworks on the 4th of July or on other special occasions; provided, that it is a community function and the fireworks are exploded under the supervision of a person duly licensed for that purpose under the Health and Safety Code of the State of California; and provided, that the site for the explosion of the fireworks has been passed upon by the fire chief as reasonably safe; and provided, that the city council can demand from the organization sponsoring the fireworks insurance or bonds sufficient to cover prospective damages. 7.25.050 Violations.

Violation of this chapter shall be deemed a misdemeanor and punishable as such. [Ord. 205 § 8, 1977]
