8.40.010 License – Required.

It shall be unlawful for any person to operate or use a bicycle propelled wholly or in part by muscular power upon any of the streets, alleys or public highways of the city of Biggs without first obtaining from the police department of the city of Biggs a license therefor. [Ord. 176 § 2, 1972]

8.40.020 License – Plate, decal.

The chief of police of the city of Biggs shall provide a license plate or decal, together with registration cards. Said license, when issued, shall entitle the licensee to operate such bicycle for which said license has been issued upon all streets, alleys and public highways in the city of Biggs, excepting as hereinafter provided. 8.40.030 License – Attaching.

The city of Biggs shall provide a license plate or decal, together with registration cards, said license plate and registration card having numbers stamped thereon in numerical order, beginning with number one and indicating the year for which the same are issued; each license plate shall be suitable for attachment upon the frame of bicycles, and said bicycle owner shall immediately attach such license plate to the frame of each bicycle. The license plate shall remain attached to such bicycle. The chief of police of the city of Biggs shall keep a record of the date of issuance of each license, to whom issued and the number thereof. 8.40.040 Sales, transfer of ownership.

It shall be the duty of every person, other than the original seller, who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the chief of police of the city of Biggs the registration card issued to such person as license thereof, together with the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made within five days of the date of such sale or transfer. It shall be the duty of the purchaser or transferee of said bicycle to apply for a transfer of registration therefor within five days of such sale or transfer. [Ord. 176 § 5, 1972]

8.40.050 Destruction of registration.

It shall be unlawful for any person to willfully or maliciously remove, destroy, mutilate or alter the number on any bicycle frame licensed pursuant to this chapter. It shall also be unlawful for any person to remove, destroy, mutilate or alter any license plate or registration card during the time in which such license plate or registration card is operative; provided, however, that nothing in this chapter shall prohibit the chief of police of the city of Biggs from stamping numbers on frames of bicycles for which no serial number can be found, or on which said number is illegible or insufficient for identification purposes. 8.40.060 License – Fee.

The annual license fee to be paid for each bicycle shall be $0.50 and pursuant to BMC 8.40.040 such license may be transferred when the ownership of said bicycle is transferred, and a fee of $0.25 shall be paid for the registration of such transfer. Licenses must be obtained within 30 days after purchasing bicycle, or becoming a resident of the city of Biggs, or the license fee will be double. License fees shall be due January 1st and delinquent January 31st of each and every year. [Ord. 176 § 7, 1972]

8.40.070 Riding on sidewalks prohibited – Skateboards and roller skates.

It shall be unlawful for any person to ride or travel or otherwise propel their bodies on a bicycle or on a skateboard or on roller skates on the sidewalks of “B” Street between Fifth Street and the Southern Pacific Railroad tracks. 8.40.080 Parking.

(1) It shall be unlawful for any person to park any bicycle upon either the sidewalks or in the streets of the city of Biggs in said business area, excepting within bicycle parking stalls authorized for such purpose. The city council shall, by resolution, designate bicycle parking stalls in the streets of the city of Biggs for bicycles and the provisions of said resolution shall be put into effect by the chief of police.

(2) Each bicycle parking stall shall be identified in the resolution by describing the face of curb of the street on which the bicycle parking stall fronts. The bicycle parking stall shall extend perpendicularly toward the center of the street eight feet from the face of curb, except that where the boundaries intersect with a vehicle parking stall or crosswalk, then the boundaries of the bicycle parking stall shall be contiguous and adjacent to the intersecting vehicle parking stall or crosswalk.

(3) Bicycle parking stalls shall be marked by red coloring along the face of curb and by a four-inch-wide red line along all other boundaries of the stall.

(4) It shall be unlawful for any person, firm or corporation to stop or park any vehicle except a bicycle as defined in BMC 8.40.010 within the boundaries of any bicycle parking stall. [Ord. 176 § 9, 1972]

8.40.090 Impoundment.

The police department of the city of Biggs may impound and retain possession of any bicycle operated in violation of the provisions of this chapter, and retain possession of same until an impound fee of $1.00 has been paid and violations corrected that can be corrected. [Ord. 176 § 10, 1972]

8.40.100 Fee alteration.

The fees set forth in this chapter can be altered by the city council from time to time by resolution, as experience and the prevailing economic situation may dictate. [Ord. 176 § 11, 1972]

8.40.110 Violations.
