13.10.010 Purpose.

(1) This title is enacted for the purpose of adopting standards, regulations and procedures for the subdivision and utilization of land in the incorporated area of the city, as authorized and directed by the Subdivision Map Act and other applicable provisions of law.

(2) This title provides for the subdivision of land, and also for the reversion to acreage of lands previously divided. [Ord. 410 § 3, 2017]

13.10.020 Authority.

(1) Pursuant to the authority conferred by Chapter 670, Statutes of 1937, known as the “Subdivision Map Act,” and amendments thereto, the following regulations and standards are hereby established and shall apply to all subdivisions or parts of subdivisions hereafter made of land wholly or partially within the incorporated territory of the city of Biggs.

(2) The provisions of this title are supplemental to those of said Map Act and all terms used herein which are defined in the Subdivision Map Act shall have the same as ascribed thereto in said Subdivision Map Act, and as the same may hereafter be amended. Wherever the term “standards of the city of Biggs” shall be used the same shall include all standards and specifications prepared by the department heads and approved by resolution of the city council. Such standards and specifications shall be subject to change by the department heads with approval of the city council by resolution from time to time, and shall be available for inspection by all interested persons in the office of the city clerk. 13.10.030 Advisory agency.

The planning commission of the city of Biggs is hereby designated as the “advisory agency” as said term is used in said Subdivision Map Act, and is charged with the duty of making investigations and reports on the design and improvements of proposed subdivisions. [Ord. 410 § 3, 2017]

13.10.040 Applicability.

This title shall not affect any agreement, contract or bond previously executed with respect to any subdivision or any rights or action accrued thereunder; or any previous action to approve a tentative map or final map, except that conditions of approval and time limitations imposed thereon shall prevail. 13.10.050 Conformity with other applicable provisions required.

All subdivisions of land which are subject to the provisions of this title shall conform to the general plan, specific plans, and to adopted standards and provisions of law which are pertinent or applicable to such divisions. [Ord. 410 § 3, 2017]

13.10.060 Units of land separate units when.

All contiguous units of land which were previous deemed merged, under the terms of the Subdivision Map Act prior to July, 1977, are hereby deemed unmerged and separate units; provided, that such units were established as separate units of record in conformance with laws applicable at the time of their establishment. 13.10.070 Fees.

The city of Biggs, pursuant to this section, shall set fees from time to time by resolution for service rendered for zoning changes, use permits, variances, amendments to the general plan, environmental reviews and impact reports, filing of maps or surveys, adjusting lot lines, checking of plans and maps and inspection of improvements.
