SMOKING PROHIBITED IN
CERTAIN PUBLIC PLACESSections:

§ 41100 Definitions.
As used in this Chapter, unless the context otherwise clearly indicates:
“Smoke” or “Smoking” shall mean the carrying or holding of a lighted pipe, cigar, cigarette or any other lighted smoking equipment or the lighting or emitting or exhaling of the smoke of a pipe, cigar, cigarette or other kind of smoking equipment. “Smoke” also means the gaseous products and particles created by the use of a lighted pipe, cigar, cigarette, or other kind of smoking equipment. § 41101 Smoking at Polling Places Prohibited.
It shall be unlawful for any person to smoke at any polling place located in the City during an election. (Ord. 90-907, § 1)
§ 41102 Smoking in Public Places Prohibited.
It shall be unlawful for any person to smoke in any building or facility owned or leased by the City or the Carson Redevelopment Agency. (Ord. 90-907, § 1)
§ 41103 Exception – Nonpublic Portions of City Buildings.
The prohibition contained in CMC 41102 does not apply to those portions of any building or facility which are leased or let to persons or entities other than the City or the Carson Redevelopment Agency. (Ord. 90-907, § 1)
§ 41104 Exception – Carson Community Center Atrium and Outside Areas of City Buildings.
The prohibition contained in CMC 41102 does not apply to the Carson Community Center atrium or to open balconies, walkways, or outside areas of buildings or facilities owned or leased by the City or the Carson Redevelopment Agency. (Ord. 90-907, § 1)
§ 41105 Posting of Signs.
The City Administrator is directed to post and prominently display “No Smoking” signs at the entrances to buildings subject to the prohibition contained in CMC 41102. All such signs shall clearly and conspicuously recite the phrase “No Smoking” and/or use the international no smoking symbol. (Ord. 90-907, § 1)
§ 41106 Violation.
Violation of this Chapter is an infraction, and shall be punishable as provided in CMC 1200(b). (Ord. 90-907, § 1)
§ 41107 Smoking Prohibited in Parks, Playgrounds and Recreation Centers.
(a) No person shall be in possession of a burning tobacco or tobacco-related product, including but not limited to cigars and cigarettes, in or upon any park, playground or recreation center.
(b) No person shall dispose of lighted or unlighted cigars or cigarettes, or cigar or cigarette butts, or any other tobacco-related waste in or upon any park, playground or recreation center.
(c) As used in this Section, “park, playground or recreation center” shall mean those City Parks and Recreational Facilities owned or controlled by the City of Carson as designated in the City’s General Plan or by action of the City Council, except for the Carson Community Center. Future facilities of the City designated in the General Plan or by action of the City Council as a park, playground or recreational center or recreational facility shall also be included in the definition of “park, playground or recreation center” without further amendment of this Section. “Park, playground or recreation center” includes, but is not limited to, the following facilities: Anderson Park, Bonita Street Mini-Park, Calas Park, Carriage Crest Park, Carson Park and Pool, Del Amo Park, Dolphin Park, Dominguez Park and Pool, Friendship Mini-Park, Hemingway Park, Mills Park, Perry Street Mini-Park, Scott Park and Pool, Stevenson Park, Walnut Street Mini-Park, and Veterans SportsComplex and Park.
(d) No person shall intimidate, threaten any reprisal, or effect any reprisal, for the purpose of retaliating against another person who seeks to obtain compliance with this Section. (Ord. 02-1250, § 2)
