9.24.010 Discharging firearms unlawful when.

No person shall discharge any firearm, or discharge or operate any airgun, air rifle, pellet gun, BB gun, slingshot, or other weapon or device capable of hurling a missile with force enough to do bodily injury to persons or damage to property, within one hundred fifty yards of any structure in the city. (Ord. 399-85 § 2, 1985)

9.24.020 Exemptions from chapter provisions.

This chapter does not apply to the following:

A. A peace officer, as defined in the California Penal Code, in the performance of official duties, or any person summoned by any such officer to assist in making arrest or preserving the peace while actually engaged in assisting such officer;

B. Any member of the military service of the United States of America, engaged in the performance of official duty;

C. Any person who necessarily discharges a weapon in the lawful defense of life or property;

D. Any licensed firearms range or shooting arcade. (Ord. 399-85 § 3, 1985)

9.24.030 Violation deemed nuisance—Surrender and disposal of weapon.

Any firearm, weapon or device described in this chapter and used in violation of the chapter is hereby declared to be a nuisance, and upon conviction of any person who violates this chapter the firearm, weapon or other device shall be surrendered to the chief of police of the city. Such firearm, weapon or other device shall thereafter be disposed of in the same manner for the disposal of nuisances under Section 12028 of the Penal Code of California. (Ord. 399-85 § 4, 1985)

9.24.040 Violation—Penalty.

Any violation of this chapter is a misdemeanor, punishable by imprisonment in the county jail for not more than six months or fine of not more than five hundred dollars, or both. (Ord. 399-85 § 6, 1985)
