HABITUAL OR COMMON DRUNKARD

5.24.01 Definition of habitual or common drunkard pursuant to Business and Professions Code Section 25602(a).

For the purposes of interpreting and enforcing California Business and Professions Code Section 25602, subdivision (a), which prohibits the sale or furnishing of alcoholic beverages to any “habitual or common drunkard,” the following definition shall apply:

“Habitual or common drunkard” shall mean either of the following: (1) any person who is arrested for a violation of Penal Code Section 647(f) (public intoxication) more than three (3) times in any six (6) month period; or (2) any person designated by the Court as an habitual or common drunkard.
