REIMBURSEMENT OF INCARCERATION COSTS FROM WEEKENDER INMATES

4AA-1 Short title.

The ordinance codified in this chapter shall be known as the “reimbursement of incarceration costs from weekender inmates measure.” (Ord. No. 474, § 1 (part).)

4AA-2 Applicability.

This chapter applies to all persons, as defined in Section 1209 of the Penal Code, who are sentenced to the Colusa County Jail as a final sentence or condition of probation and are allowed by the court to continue their regular employment by serving their sentence on weekends or other days during the week which are non-workdays. California Penal Code Section 1209 and any subsequent amendments to said section are adopted by the county and incorporated by reference herein. (Ord. No. 474, § 1 (part).)

4AA-4 Ability to pay; determination hearings.

The ability to pay the applicable fee shall be determined by a hearing conducted by the appropriate court pursuant to the hearing procedures set forth in Section 1209 of the Penal Code. (Ord. No. 474, § 1 (part).)

4AA-5 Collection of fees.

The county sheriff shall collect the appropriate fees prior to or upon completion of each weekly or monthly period of confinement, until the entire sentence has been served in accordance with the defendant’s ability to pay. (Ord. No. 474, § 1 (part).)

4AA-6 Deposit of moneys collected.

All sums collected pursuant to this chapter shall be deposited into the general fund of Colusa County. (Ord. No. 474, § 1 (part).)

4AA-7 Per-day costs determined.

The amount of the per-day incarceration costs to be charged each defendant under this chapter shall be equal to the amount determined pursuant to chapter 4A of this code. (Ord. No. 474, § 1 (part).)
