7C-1 Purpose – Statutory authority.

In accordance with the authority granted by the state of California under Section 12240 of the Business and Professions Code, an annual device registration fee may be charged establishments and individuals using commercial weighing and measuring devices. (Ord. No. 481, § 1 (part).)

7C-2 Definitions.

(a)  “Commercial weighing and measuring devices for which a registration fee is required” means such devices as classified in the California Code of Regulations, Title IV, Chapter 9, Subchapter 1, Article 2, commencing with Section 4001.

(b)  “Device registration certificate” means a certificate issued to a person upon proper payment of the device registration fee.

(c)  “Sealer of weights and measures” means the county sealer of weights and measures of the Colusa County department of agriculture, its agents and employees duly authorized to act on behalf of said department. (Ord. No. 481, § 1 (part).)

7C-3 Device registration certificate.

(a)  No person shall temporarily or permanently, alone or in conjunction with others, maintain or operate any commercial weighing or measuring device without first obtaining an annual device registration certificate.

(b)  The device registration certificate shall be posted in public view. (Ord. No. 481, § 1 (part).)

7C-4 Application and fees.

(a)  Applications for device registration certificates and renewals thereof shall be filed with the sealer of weights and measures upon such forms as he or she may prescribe.

(b)  The device registration certificate fee for the calendar year or any part thereof during which the activity is covered by this chapter shall be that established by resolution of the board of supervisors.

(c)  Each device registration certificate shall expire on December 31st of the current year, provided such permit may be renewed without penalty on or before February 15th next following the expiration date. The penalty shall be that established by resolution of the board of supervisors. (Ord. No. 481, § 1 (part).)

7C-5 Severability.

If any section, subsection, sentence, clause, phrase or portion of this chapter is for any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed as a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
