12C-1 Declaration of intent.

The board of supervisors finds and declares that the accumulation of abandoned, wrecked, dismantled or inoperative vehicles or parts thereof on county roads, highways and rights-of-way is hereby found to reduce the value of surrounding private property; to promote blight and deterioration; to create fire hazards; to constitute an attractive nuisance creating a hazard to the health and safety of minors; to create a harborage for rodents and insects and to be injurious to the general health and welfare. The presence of abandoned, wrecked, dismantled or inoperative vehicles on county highways, roads and rights-of-way, except as expressly herein provided, is hereby declared to constitute a public nuisance which may be abated as such in accordance with the provisions of this chapter. 12C-2 Administration and enforcement.

This chapter may be administered and enforced by any peace officer, as defined in chapter 4.5 (commencing with Section 830) of title 3 of part 2 of the California Penal Code. (Ord. No. 508.)

12C-3 Statutory authority.

The enactment of this chapter is expressly authorized by California Vehicle Code Sections 22651(k) and 22660. (Ord. No. 508.)

12C-4 Nonexclusive remedy.

This chapter is not intended to be the exclusive regulation of abandoned, wrecked, dismantled or inoperative vehicles within the unincorporated area of the county. It shall supplement and be in addition to such other regulatory codes, statutes and ordinances as are heretofore or hereinafter enacted by the county, state or other regulatory agency or entity having jurisdiction. 12C-5 Definitions.

As used in this chapter:

(a)  Highway, road and right-of-way shall include but not be limited to mean a way or place of whatever nature, including streets, alleys, trails, paths and county rights-of-way, publicly maintained and open to use by the public for the purpose of pedestrian or vehicular travel within the county.

(b)  Vehicle shall mean a device by which any person or property may be propelled, moved or drawn upon a highway, road or street, as those terms are defined herein. (Ord. No. 508.)

12C-6 Presumption of abandonment; removal.

Any vehicle found unattended upon a county road, highway, street or right-of-way for seventy-two hours or more shall be presumed to be abandoned and may be removed in accordance with Section 22651 et seq. of the California Vehicle Code. (Ord. No. 508.)

12C-7 Abatement and removal; procedure.

Abatement and removal of abandoned, wrecked, dismantled or inoperative vehicles under this chapter shall be performed in accordance with the provisions of California Vehicle Code Sections 22850 through and including 22855, inclusive. (Ord. No. 508.)

12C-8 Costs of administration and removal.

Costs for the administration and removal of abandoned, wrecked, dismantled or inoperative vehicles under this chapter may be recovered in accordance with the provisions of California Government Code Sections 25845 or 38773.5. (Ord. No. 508.)
