17A-1 Statutory authority.

The ordinance codified in this chapter is adopted pursuant to Section 25537 of the Government Code. (Ord. No. 443, § 1 (part).)

17A-2 Applicability – Exceptions.

All sales or leases of real property owned by the county shall be made in accordance with Sections 25526 to 25535 inclusive of the Government Code, with the following exceptions:

(a)  Leases of a duration not exceeding five years and having an estimated monthly rental of not exceeding one thousand dollars may be excluded from the bidding procedure. If a lease is excluded from the bidding procedure, the actual monthly rental in the executed lease shall not exceed one thousand dollars, the term of the executed lease shall not exceed five years, and the lease shall not be renewable.

(b)  Unless excepted under subsection (a) above, the board of supervisors, when leasing county real property, shall do all of the following:

(1)  Set a time and place for the opening of sealed proposals for the leasing of real property;

(2)  Prepare a notice to bidders, which shall state such time and place for the bid opening, describe the property so as to clearly identify it and make reference to the form of the proposed lease, and state that the lease shall be on file in the office of the county clerk and shall be open to inspection by any interested party;

(3)  Post the notice to bidders in at least three public places for not less than fifteen days prior to the bid opening;

(4)  Publish the notice to bidders for not less than two weeks prior to the bid opening in a newspaper of general circulation;

(5)  Either accept the highest proposal for the proposed lease, or reject all bids. (Ord. No. 443, § 1 (part).)
