40-1 Findings and declarations of the board of supervisors.

The board of supervisors finds and declares that the provisions of Government Code Section 29550 will be implemented, as per legislative intent, to partially recover revenue lost by the county due to state budget costs. (Ord. No. 678, § 1 (part).)

40-2 Authority.

A justice administrative fee for the booking and processing of arrested persons is established under the authority of Government Code Section 29550. (Ord. No. 678, § 1 (part).)

40-3 Fee imposed.

A justice administrative fee for the booking and processing of arrested persons brought to the county jail for booking or detention by an employee of the city, special district, school district, community college district, college or university on or after January 1, 1993. The fee shall be set at sixty-three dollars and fifty-nine cents. (Ord. No. 678, § 1 (part).)

40-4 Definitions.

The following words and phrases whenever used in this chapter shall be construed as defined in this section.

(a)  “City” means any incorporated city within the political boundaries of Colusa County.

(b)  “Special district, school district, community college district, college or university” means any such district, which operates within the political boundaries of Colusa County.

(c)  “Arrested person” means any person arrested by an employee of a city, special district, school district, community college district, college or university, for probable cause or in obedience to an original warrant. Bookings for out-of-county warrants, remands, bail bond surrenders, en route booking, and commitments are not subject to the fee.

(d)  “Booking and processing” means all activities necessary or appropriate for the reception and detention of arrested persons at county detention facilities, from the time the arrested person is initially presented to facility staff until the person is either released or assigned to permanent housing within the facility. In general terms such activities include, but are not limited to, initial reception, fingerprinting, photography, criminal record screening, early release screening, classification, medical screening, data entry, personal property accounting, security and release processing. 40-5 Fee structure.

The “booking fee” shall include, but not exceed, the actual administrative costs, including applicable overhead costs, as permitted by federal Circular A-87 standards, incurred in booking and processing arrested persons. (Ord. No. 678, § 1 (part).)

40-6 Billing.

Cities, special districts, school districts, community college districts, colleges or universities who bring prisoners to the county jail will be billed quarterly on or after January 1, 1993 for booking and processing prisoners on or after January 1, 1993. Cities, special districts, school districts, community college districts, colleges or universities will subsequently be billed quarterly. (Ord. No. 678, § 1 (part).)

40-7 Actions to collect.

Any fee required to be paid by a city, special district, school district, community college district, college or university under this chapter shall be deemed a debt owed to the county. In the event that such fee is unpaid, the city, special district, school district, community college district, college or university shall be liable to any action brought in the name of the county for the recovery of such amount. 40-8 Waiver of fee.

The board of supervisors may elect to waive the imposition of fees on a particular agency if a prior agreement has been made whereby the city, special district, school district, community college district, college or university has provided valuable consideration in return for waiver of the fee.
