20.41.010 Purpose.

It shall be unlawful for any person to drive a paratransit vehicle permitted by the City unless such person has an operations permit: paratransit driver issued by the City. (Ord. 2086 § 2 (Exh. A), 2018; Ord. 1686)

20.41.020 Definitions.

A. The words and phrases set forth in CMC 20.40.030 are hereby incorporated by this reference as though set forth in this chapter.

B. “Cruising” shall mean the movement over the public streets of a paratransit vehicle in search of or to solicit prospective passengers. The term does not include the travel of a paratransit vehicle to provide a prearranged trip, or to discharge a passenger or passengers, or returning to the owner’s place of business of the owner of the paratransit vehicle.

C. “Driver” shall mean a person who operates the paratransit vehicle and includes a driver who also owns the paratransit vehicle. (Ord. 2086 § 2 (Exh. A), 2018)

20.41.030 Issuing authority.

The Director of Police Services is authorized to issue operations permit: paratransit driver to those drivers of vehicles properly issued an operations permit: paratransit by the City of Coronado. (Ord. 2086 § 2 (Exh. A), 2018)

20.41.050 Regulations.

A. The permittee shall maintain a valid, unsuspended California State driver’s or chauffeur’s license during the period of the permit.

B. The permittee shall not be convicted of driving under the influence of intoxicating liquor or narcotics during the period of the permit, nor any crime involving pimping, pandering, prostitution, sexual assault, indecent exposure, annoying or molesting any minor, or possession, sales, or distribution of any controlled substance.

C. During the period of the permit, the permittee shall not have had three or more convictions of any of the offenses set forth in Sections 22350, 22351, 23153, 23152, 23103, and 12104 of the Vehicle Code of the State of California.

D. The permittee shall promptly obey all lawful orders or instructions of any police officer or firefighter within the City.

E. The permittee shall not accept into the paratransit vehicle a larger number of persons than the rated seating capacity of the paratransit vehicle.

F. The permittee shall take the most direct route possible when carrying a passenger to their destination with safety and traffic regulations.

G. The permittee shall not solicit potential passengers by driving in such a manner as to interfere with access to or egress from any public place. However, the permittee may solicit for passengers by driving through any public street or place, without stops other than those due to obstruction of traffic, or traffic regulations, and at such speed as not to interfere with or impede traffic, consistent with the traffic speed regulations.

H. The permittee shall not solicit passengers for any paratransit vehicle unless the permittee is sitting upon the driver’s seat of that vehicle.

I. No driver of any paratransit vehicle shall transport any passenger without charging the disclosed fee pursuant to CMC 20.40.150. (Ord. 2086 § 2 (Exh. A), 2018)
