20.42.010 Purpose.

It shall be unlawful for any person to operate an electric personal assistive mobility device (EPAMD) business within the Coronado City limits unless such person has been issued a business operations permit: EPAMD, by the City of Coronado. (Ord. 1998 § 1, 2008)

20.42.020 Definitions.

A. “EPAMD” shall mean an electric personal assistive mobility device (as defined by California Vehicle Code Section 313).

B. “EPAMD business” shall mean a proprietorship, partnership, corporation, and any other form of commercial enterprise whose purpose is the sale, rent, or lease of one or more electric personal assistive mobility devices. (Ord. 1998 § 1, 2008)

20.42.030 Issuing authority.

The Director of Administrative Services is authorized to issue a business operations permit: EPAMD. (Ord. 1998 § 1, 2008)

20.42.040 Regulations – EPAMD business.

A. No person shall engage in the operation of an EPAMD business within the City except as authorized by a valid business operations permit: EPAMD and such other permits and licenses as are required by law.

B. No person who is engaging in the operation of an EPAMD business shall allow use of, or lease, or rent an EPAMD to a customer unless the customer is also provided, and is required to wear, a safety helmet which meets the specifications of Vehicle Code Section 21212.

C. A person who is engaging in the operation of an EPAMD business shall require customers under the age of 16 years to be accompanied by a parent or guardian at all times.

D. No person who is engaging in the operation of an EPAMD business shall allow use of, or lease or rent an EPAMD to a customer under the influence of alcohol, drugs or controlled substances.

E. No person who is engaging in the operation of an EPAMD business within the City shall employ a person to operate an EPAMD unless such operator has a valid driver’s license or California identification card.

F. A person who is engaging in the operation of an EPAMD business in the City shall:

1. Limit their business operations to demonstrating, selling, leasing, and/or renting EPAMDs. Additionally, a person operating an EPAMD business may provide EPAMDs for the purpose of conducting escorted tours within the Coronado City limits.

2. Ensure that EPAMDs are equipped with proper safety mechanisms as set forth in California Vehicle Code Section 21281.

3. Provide on-site education and safety training to all customers.

4. Keep its EPAMD fleet clean and neat in appearance during operating hours.

5. Ensure their EPAMDs are clearly identified with company markings.

6. Not park or store their EPAMD fleet on City property or City rights-of-way, including but not limited to City streets, sidewalks, parkways, parks, or parking lots.

7. Require tour groups of two or more participants to travel in a single-file procession.

8. Both verbally and in writing, inform customers of the applicable rules and regulations for the operation of EPAMDs in the City of Coronado, so that they are fully informed of restrictions on the operations as described in Chapter 56.90 CMC. Operators of an EPAMD business shall satisfy the requirement of providing written information if the business has: (a) posted conspicuous signage at the business location, listing the restrictions contained in Chapter 56.90 CMC; and (b) required each person renting or operating an EPAMD to certify that the person has (i) received a copy of written information, (ii) read the written information, and (iii) understands the restrictions set forth in the document. Both the signage and the written information must be approved by the Director of Administrative Services or designee.

G. A person who is engaging in the operation of an EPAMD business on tidelands property (including the Coronado Ferry Landing) shall obtain all required permits from the San Diego Unified Port District.

H. No person who is engaging in the operation of an EPAMD business shall use Orange Avenue for the purpose of demonstrating an EPAMD to customers or allow customers to commence or terminate the operation of their EPAMD on Orange Avenue. (Ord. 2007 § 1, 2010; Ord. 1998 § 1, 2008)

20.42.050 Public liability.

A. It shall be unlawful for a person to operate an EPAMD business in the City without obtaining and maintaining in effect commercial general liability insurance coverage in the minimum amounts and forms as required by Administrative Procedure 5‑13, or such other policy as may be in effect from time to time.

B. Failure to procure or maintain the required insurance shall constitute grounds for the City to immediately terminate the operations permit: EPAMD, issued to the permit holder. (Ord. 1998 § 1, 2008)

20.42.060 Fees.

In accordance with CMC 20.02.050, a person who is engaging in the operation of an EPAMD business in the City shall pay an annual permit fee as determined from time to time by resolution of the City Council. (Ord. 1998 § 1, 2008)

20.42.070 Enforcement.

Any person engaging in the operation of an EPAMD business in violation of the provisions of this chapter shall have their business operations permit: EPAMD revoked by the issuing authority in accordance with Chapter 20.02 CMC. (Ord. 1998 § 1, 2008)
