41.14.010 General prohibitions.

Notwithstanding the provisions of Chapter 41.14 CMC, it shall be unlawful for any person to make, continue, or cause to be made or continued, within the limits of said City, any disturbing, excessive, or offensive noise which causes discomfort or annoyance to any reasonable person of normal sensitiveness residing or working in the area. The Noise Control Officer will evaluate the reasonableness of the complaint and the sensitiveness of the person or persons by the criteria set forth in CMC 41.12.020.

41.14.020 Specific prohibitions.

The following activities are declared to constitute a violation of this chapter and said enumeration shall not be deemed to be exclusive, namely:

A. Animals.

1. The keeping or maintenance, or the permitting to be kept or maintained, of any animal or animals upon any premises owned, occupied, or controlled by any person, which cause frequent or long continued noise.

2. Prima Facie Violations. The noise of any animal or animals that disturbs two or more residents who are in general agreement as to the times and durations of the noise, and who reside in separate residences (including apartments and condominiums) located on property adjacent at any point to the property in which the subject animal or animals are kept or maintained shall be prima facie evidence of a violation of this subsection.

B. Burglar Alarms. The use of audible burglar alarms for structures unless such burglar alarm shall be capable of terminating its operation automatically within 20 minutes of its being activated. Notwithstanding the requirements of this provision, any member of the Police Department, or representative of the Noise Control Officer of the City of Coronado shall have the right to take such steps as may be reasonable and necessary to disconnect any such alarm installed on a structure at any time after 20 minutes of activation. Any structure upon which a burglar alarm has been installed shall prominently display the telephone number through which communication may be made with the owner of such building or the company which maintains the alarm system.

C. Loading, Unloading, Materials, Etc.

1. Loading, unloading, opening, closing or other handling of boxes, crates, containers, building materials, garbage cans, produce, or similar objects between the hours of 10:00 p.m. and 7:00 a.m. which is clearly audible in a Residential Zone.

2. Playing of sound amplifying equipment on public property. The operation of any sound amplifying equipment, that exceeds 60 decibels at 10 feet from the source, is prohibited on a City of Coronado beach, park, sidewalk, or other public right-of-way.

D. Horns, Signaling Devices, Etc. Unnecessary use or operation of horns, signaling devices, etc., on automobiles, motorcycles or any other vehicle.

E. Places of Public Entertainment.

1. Operating or permitting the operation or playing of any loud speaker or musical instrument in any place of public entertainment that exceeds 90 decibels, one-hour average sound level at the listeners’ ears unless a conspicuous and legible sign has been posted as follows:

WARNING! SOUND LEVELS IN THIS BUILDING MAY CAUSE HEARING IMPAIRMENT.

2. Tampering. The removal or rendering inoperative, other than for purposes of maintenance, repair or replacement, of any noise control device or sign is prohibited.

F. Duly licensed parades, sound amplifying equipment mounted on motor vehicles, live bands for use in residential property, or any other proposed use which has a high potential for noise disturbance is unlawful unless a noise control permit has been applied for and granted by the Noise Control Officer.

G. Nonvehicular Motorized Equipment.

1. No person shall operate nonvehicular motorized equipment between the hours of 7:00 p.m. to 7:00 a.m. which is clearly audible in any Residential Zone unless a noise control permit has been applied for and granted by the Noise Control Officer.

2. Construction and Repair of Vehicles or Marine Vessels. No person shall construct, alter or repair any vehicles or marine vessels between the hours of 7:00 p.m. to 7:00 a.m. or on legal holidays, Saturdays or Sundays in such a manner as to create offensive noise which is clearly audible in any Residential Zone unless a noise control permit has been applied for and granted by the Noise Control Officer.

3. No person or persons shall hire or cause to be hired anyone using internal combustion powered gardening equipment between the hours of 7:00 p.m. to 7:00 a.m. or on legal holidays and Sundays which is clearly audible in any Residential Zone unless a noise control permit has been applied for and granted by the Noise Control Officer.

H. Street Sales. Offering for sale, selling or advertising by amplified sound without a noise control permit is prohibited.

I. Yelling, Shouting, Etc. Loud or raucous yelling, shouting, hooting, whistling or singing on public streets between the hours of 10:00 p.m. and 8:00 a.m. within said City limits is hereby prohibited.
