41.18.010 Infractions.

Any person violating any of the provisions of this title shall be deemed guilty of an infraction. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.

41.18.020 Abatement orders.

In lieu of issuing a notice of violation as provided for in CMC 41.18.030, the Noise Control Officer responsible for enforcement of any provision of this title may issue an order requiring abatement, within a reasonable time period, of a sound source alleged to be in violation. 41.18.030 Notice of violation.

Violation of any provision of this title shall be cause for a notice of violation to be issued by the Noise Control Officer or other designated responsible enforcement official according to procedures which the Director of Community Development may prescribe.

41.18.040 Violations Additional remedies injunctions.

As an additional remedy, any violation of any provision of this title shall be deemed and is hereby declared to be a public nuisance and may be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction. Additionally, no provision of this title shall be construed to impair common law or statutory cause of action, or legal remedy therefrom, of any person for injury or damage arising from any violation of this title or from other law.

41.18.050 Severability.

If any provision of this title is held to be unconstitutional or otherwise invalid by any court of competent jurisdiction, the remaining provisions of this title shall not be invalidated.
