3.40.010 Definition.

“Public project” within the meaning of the ordinance codified in this chapter shall be defined by reference to the Uniform Public Construction Cost Accounting Act (Public Contract Code Section 22002). All Public Contract Code sections referenced in this section in effect at time of ordinance adoption are included as Exhibit “A” for reference only. The PCC section language in effect at the time of bid shall take precedence. (Ord. 816 § 1(part), 2008: Ord. 584 § 1, 1993: Ord. 575 § 1(part), 1992).

3.40.020 Intent – Compliance with state policy.

It is intended by the ordinance codified in this chapter to maintain the city’s compliance with the Uniform Public Construction Cost Accounting Act, contained in the Public Contract Code, Section 22010 et seq., and to provide for the letting of all public project contracts in this city subject to, and in accordance with, the Act as in effect at the date the project is bid. The city shall comply in all respects with the public construction cost accounting policies and procedures as promulgated by the State Controller and shall cooperate with the California Uniform Construction Cost Accounting Commission in any review of the city’s accounting procedures conducted by the commission. 3.40.030 Force account and informal bidding – When allowed.

A. Public projects in the amount specified in Public Contract Code (PCC) Section 22032(a) or less may be performed by city employees by force account or negotiated contract.

B. Public projects in the amount specified in PCC Section 22032(b) or less may be let to contract by informal procedures as set forth in Article 3 of Chapter 2 of the Public Contract Code commencing with Section 22030. (Ord. 816 § 1(part), 2008: Ord. 575 § 1(part), 1992).

3.40.040 Formal bidding – When required.

Public projects of more than the amount specified in PCC Section 22032(c) may be let to contract by formal bidding procedures as set forth in the PCC commencing with Section 22030, particularly Section 22037. (Ord. 816 § 1(part), 2008: Ord. 575 § 1(part), 1992).

3.40.050 List of qualified contractors.

A list of qualified contractors shall be maintained as per PCC Section 22034(a). (Ord. 816 § 1(part), 2008: Ord. 575 § 1(part), 1992).

3.40.060 Informal bid invitation.

Shall be in compliance with requirements of the PCC Section 22034 in effect the date the project is bid. (Ord. 816 § 1(part), 2008: Ord. 575 § 1(part), 1992).

3.40.070 Council approval for exceptions.

Informal and formal bidding procedures will be allowed only in accordance with PCC Section 22050 in effect at the time. (Ord. 816 § 1(part), 2008: Ord. 602 § 2, 1993).
