HAZARDOUS MATERIALS

10.50.010 Vehicles transporting hazardous materials.

No person shall leave any vehicle transporting a hazardous material waste or substance, as identified in Title 49 of the Code of Federal Regulations and Title 22 of the California Code, unattended on public places or private property, except:

A. When loading or unloading the vehicle;

B. When inside a bulk plant, chemical plant or processing plant and twenty-five feet from any property line or within a building approved for such use;

C. When the vehicle is parked on private property in a location not less than one hundred feet from any building except parking lots approved for the storage or servicing of such vehicles;

D. In case of breakdown or emergency, the operator shall notify the police or fire department of the problem and what actions are necessary to correct the problem; or

E. While the operator is eating a meal or using lavatory facilities and is within one hundred feet of the vehicle. (Ord. 785 § 1(part), 2006).

10.50.020 Hazardous material vehicle operators.

A. A motor vehicle is “attended” when the person in charge of the vehicle is an “operator” as defined in this section, and is on the vehicle and awake.

B. An “operator” is defined as a person who:

1. Has been designated by the carrier to attend the vehicle;

2. Is aware of the nature of the hazardous material or substance contained in the vehicle he attends;

3. Has been instructed on the procedures he must follow in emergencies concerning hazardous materials or substances;

4. Is authorized to move the vehicle and has the means and ability to do so. (Ord. 785 § 1(part), 2006).
