2.28.010 Purpose.

The purpose of this chapter is the establishment of a community services commission to serve as an advisory commission to the city council and the parks and community services manager. (Ord. 92-14 § 2 (part), 1992)

2.28.020 Establishment.

A.    A community services commission is established by the city and will act in an advisory capacity to the city council, the administrative community services and the community development managers.

B.    The community services commission shall have seven members appointed in accordance with the provisions of this chapter. Subject to Section 2.28.030, five of such members shall be appointed from each of the city’s voting districts and two members shall be appointed at large. An appointed member from a city voting district shall be a resident of the voting district from which he/she is appointed. An appointed member at large shall be appointed from within the Dinuba high school district boundaries as currently set or as subsequently amended and cannot be a resident of the city. If any appointed member of the commission subsequently changes permanent residence to a place outside of the voting district, then said position shall become automatically vacant and shall be filled as any other vacancy. If any appointed, at-large member of the commission subsequently changes permanent residence to a place outside of the Dinuba high school district boundaries, or changes permanent residence to a place within the city limits, said position shall become automatically vacant and shall be filled as any other vacancy. 2.28.030 Members—Appointment.

A.    The members of the commission appointed to those positions representing the voting districts within the city shall be appointed by recommendation of the council member representing the voting district from where the vacancy occurred, with the approval of the city council by majority vote.

B.    The members of the commission who are serving at large shall be appointed by majority vote of the city council.

C.    In the event that a position representing one of the five voting districts of the city cannot be filled by a resident of the district where the vacancy occurred, then the council member representing the voting district from which the vacancy occurred shall nominate another person whose residence must be within the city. Said nomination shall be subject to the approval of the city council by majority vote.

D.    In the event that a position representing one of the at-large designations cannot be filled from within the Dinuba high school district boundaries, but outside of the city, that position may be filled by any member residing within the city, and shall be appointed by majority vote of the city council. 2.28.040 Members—Terms.

Of the members of the commission first appointed, three shall be appointed for terms of two years and four for terms of three years. Their successors shall be appointed for terms of three years. (Ord. 95-2 § 2 (part), 1995)

2.28.050 Operating policies.

Except as otherwise provided in this chapter, the commission shall conform to the policies as established by resolution of the city council and as subsequently amended by majority vote of the city council. (Ord. 95-2 § 2 (part), 1995: Ord. 92-14 § 2 (part), 1992)

2.28.060 By-laws.

With the assistance of the members of city staff, the commission shall, by resolution, adopt by-laws by which it shall conduct the order of its business. Said by-laws shall be subject to the approval of the city council by majority vote. (Ord. 95-2 § 2 (part), 1995: Ord. 92-14 § 2 (part), 1992)

2.28.070 Officers and elections.

The commission shall elect a chairperson and vice-chairperson whose terms shall be for one year and the election shall be conducted at the first meeting in January of each year. (Ord. 95-2 § 2 (part), 1995: Ord. 92-14 § 2 (part), 1992)

2.28.080 Meetings.

The commission shall meet the third Tuesday of each month at the city council chambers located at 405 E. El Monte Way, Dinuba, California at six p.m. (Ord. 98-3 § 1, 1998)

2.28.090 Brown Act.

The commission shall be governed by the provisions of the Brown Act (Government Code Section 54950 et seq.). (Ord. 95-2 § 2 (part), 1995: Ord. 92-14 § 2 (part), 1992)

2.28.100 Commission duties.

A.    The community services commission shall advise public officials and the general public of the leisure time and human service needs, facilities and services of the citizens of Dinuba in order that adequate support may be obtained for programs therefor. It may recommend general policies concerning all parks and recreation properties, facilities, plans, programs and activities. It may evaluate suggestions, criticisms and comments in light of such policies. It may recommend a long range program for the improvement, acquisition and development of parks and recreation facilities and for the extension of services.

B.    It shall be the duty of the commission to cooperate with any other public authorities to aid and assist in the coordinating of parks and recreational facilities, pursuant to and in accordance with that certain act of legislature of the state known as the California Community Recreation Enabling Act of 1939.

C.    The commission shall perform such additional duties as may be designated by the city council by ordinance or resolution. (Ord. 95-2 § 2 (part), 1995: Ord. 9214 § 2 (part), 1992)

2.28.110 Involuntary termination of appointment.

The city council may terminate any appointment at any time upon its own motion. In addition, the city council will consider the termination of an appointment to the commission should the commissioner so appointed meet one or more of the following criteria:

A.    A commissioner who absents himself/herself for any reason from the commission meeting shall request to have such absence appear on the agenda of the following month’s regular commission meeting for the commission to consider whether the absence was an excused absence. Failure of a commissioner to make such a request shall result in the absence as being recorded as unexcused. A commissioner’s attendance record shall be forwarded to the council for action in either of the following circumstances:

1.    If the commissioner fails to attend three consecutive regular meetings of the commission without any of that commissioner’s three absences having been excused by the commission; and/or

2.    If the commissioner fails to attend eighty-five percent of the scheduled meetings of the commission during any period of twelve consecutive months. For the purpose of calculating this percentage, meetings for which the commissioner’s absence was excused by the commission shall not be counted as a failure to attend.

B.    If the commissioner is convicted of a crime of moral turpitude. (Ord. 97-7 § 1, 1997)
