18.08.010 Purposes.

The purpose of the CN neighborhood commercial district is to encourage the development of limited retail commercial and service uses to meet the day-to-day needs of local residents. The principal uses in this district would be food and beverage retail sales combined with general retail sales. The intent of the district is to implement the goal of the land use element of the Dixon General Plan, which provides for the establishment of local convenience centers to serve new and existing residential neighborhoods. Typically the district would be applied to areas serving only a limited local market, and would permit only those uses which did not create, in the adjacent residential area, increased traffic, noise or other incompatible impacts. In addition, the scale and design of uses allowed will need to reflect those of the surrounding residential neighborhood. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.020 Permitted uses.

The following uses shall be permitted:

A. Retail stores, offices and service establishments including but not limited to the following:

1. Antique stores;

2. Art galleries;

3. Bakeries;

4. Barber shops and beauty shops;

5. Bicycle shops;

6. Book stores;

7. Business and professional schools;

8. Candy stores;

9. Clothing and shoe stores;

10. Copying and printing services;

11. Dry cleaning and laundries;

12. Drug stores;

13. Fashion accessory stores;

14. Financial institutions, banks, and savings and loans;

15. Fitness centers;

16. Florists;

17. Food lockers;

18. Food markets and delicatessens;

19. Furniture and floor covering stores;

20. Gift shops;

21. Hardware stores;

22. Hobby and toy stores;

23. Household appliance stores;

24. Interior decorating studios and shops;

25. Jewelry stores;

26. Leather goods and luggage stores;

27. Tobacco stores;

28. Locksmiths;

29. Medical and dental offices;

30. Messenger offices;

31. Millinery shops;

32. Music, dance and martial arts schools;

33. Music stores;

34. Newsstands;

35. Nurseries and garden supply stores; provided, that all equipment, supplies and merchandise other than plants shall be kept within a completely enclosed building and that fertilizer of any type shall be stored and sold in packaged form only;

36. Office supplies and equipment stores;

37. Optical goods and services;

38. Paint and wallpaper stores;

39. Pet and pet supply stores;

40. Photographic supply and processing services;

41. Photography studios;

42. Picture framing shops;

43. Post office and parcel services;

44. Professional and administrative offices;

45. Restaurants without drive-through;

46. Saddlery stores;

47. Self-service laundries;

48. Shoe repair shops;

49. Shoe stores;

50. Sporting good stores;

51. Stationery stores;

52. Stamp and coin shops;

53. Tailors;

54. TV and radio station offices or studios;

55. Travel agencies;

56. Watch and clock repair shops.

B. Parking lots improved in conformity with the standards prescribed in Chapter 18.27 DMC.

C. Accessory structures located on the same site as a permitted or conditional use.

D. Accessory temporary uses, subject to the provisions of Chapter 18.22 DMC.

E. Temporary parking lots for events sponsored by a public agency.

18.08.030 Conditional uses.

The following uses shall be permitted upon the granting of a use permit as provided in Chapter 18.25 DMC:

A. Bars;

B. Child care centers;

C. Communication equipment buildings;

D. Gasoline stations;

E. Liquor stores;

F. Massage establishments;

G. Public and private charitable institutions;

H. Public and private libraries, art galleries and museums;

I. Public buildings and grounds;

J. Public parks and playgrounds and other public recreation facilities;

K. Public utility and public service pumping stations, power stations, drainage ways and structures, and storage tanks;

L. Transit stations;

18.08.040 Screening and landscaping.

All uses shall provide screening and landscaping as required in Chapter 18.33 DMC. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.050 Required conditions.

A. All business services and processes shall be conducted entirely within a completely enclosed structure, except for off-street parking and loading areas, gasoline stations, utility substations, outdoor dining areas, plant nurseries, garden shops, Christmas tree sales, bus depots and transit stations. Outdoor storage of material, supplies and vehicles under repair shall be in an approved screened storage area, unless otherwise approved by the City Planning Commission.

B. All products produced on the site of any of the permitted uses shall be sold on the site where produced.

C. Not more than five (5) persons shall be engaged in the production, repair, or processing of materials, except that this provision shall not apply to bars and restaurants. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.060 Performance standards.

All existing and proposed uses shall be subject to the requirements of Chapter 18.28 DMC. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.070 Required yards.

A. The minimum front yard shall be ten (10) feet except when the site adjoins an A or R district, in which case the minimum front yard shall be fifteen (15) feet.

B. Minimum side and rear yards: none, except in the following instances:

1. On a reversed corner lot adjoining a key lot in an R or A district, the minimum street side yard shall be not less than one-half of the required front yard on the key lot.

2. The minimum side yard or rear yard adjoining an R or A district shall be twenty (20) feet.

3. One (1) foot shall be added to each required side yard or rear yard for each two (2) feet of height or fraction thereof by which a portion of a structure within thirty (30) feet of the nearest side or rear property line exceeds fourteen (14) feet in height. 18.08.080 Minimum lot size.

The minimum site area shall be twenty thousand (20,000) square feet. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.090 Height of structures.

The maximum height of any structure shall be thirty (30) feet. The maximum height of any freestanding sign shall be twenty (20) feet. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.100 Signs.

No sign or display of any character shall be permitted except as prescribed in Chapter 18.24 DMC. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.110 Off-street parking and loading facilities.

Off-street parking and loading facilities shall be provided as prescribed in Chapter 18.27 DMC. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.120 Design review.

All uses shall be subject to design review as provided in Chapter 18.23 DMC. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]

18.08.130 General provisions and exceptions.

All uses shall be subject to the general provisions and exceptions prescribed in Chapter 18.20 DMC. [Ord. 13-008 § 2; Ord. 13-009 § 2(1).]
