2.70.010    Criminal history information - access by City Manager

2.70.010 CRIMINAL HISTORY INFORMATION - ACCESS BY CITY MANAGER.

A.    Only the duly appointed City Manager, working directly through the office of the Chief of Police, and the Chief of Police and City Council are hereby authorized to have access to the “State Summary Criminal History Information,” as provided for in Cal. Penal Code § 11105 for the purpose of evaluating the criminal history of prospective City employees to assure compliance with this chapter.

B.    If any section, sentence, subsection, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional by a decision of a court of competent jurisdiction, the decision shall not affect the validity of the remaining portions of the chapter. The City Council hereby declares that it would have passed this chapter, any section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one (1) or more other sections, subsections, sentences, clauses, or phrases may be declared invalid or unconstitutional.
