7.08.010 ANIMAL CONTROL OFFICER -APPOINTMENT.

Appointment of Animal Control Officer(s) shall be made by the City Manager, by designation, delegation or contract. (Ord. 891, § 2, passed 02-14-2011)

7.08.020 ANIMAL CONTROL OFFICER -POWERS AND DUTIES.

An Animal Control Officer shall, upon appointment and qualification, become and be vested with the powers and duties of peace officers, as limited by § 818 of Cal. Penal Code, and each shall have the power and it shall be his or her duty to issue citations for violation of any of the provisions of Title 7, as provided in Cal. Penal Code § 853.6. 7.08.030 ANIMAL CONTROL OFFICER -DUTIES -CITY CONTRACT WHEN.

The City Council may contract with any responsible organization for the performance of all or any portion of those duties imposed upon an Animal Control Officer. (Ord. 891, § 2, passed 02-14-2011)

7.08.040 ANIMAL CONTROL OFFICER -IDENTIFICATION BADGE.

An Animal Control Officer and his or her deputies while engaged in the execution of their duties under this chapter or other animal control regulation, shall each wear in plain view a badge authorized by the City Council. (Ord. 891, § 2, passed 02-14-2011)

7.08.050 RIGHT OF ENTRY FOR INSPECTION.

For the purpose of discharging his or her duties imposed by Title 7 of the Fort Bragg Municipal Code, an Animal Control Officer and his or her deputies are hereby authorized and directed to enter upon any enclosed or unenclosed property upon which any animal is kept or found in violation of the provisions of Title 7, and to demand from the person owning or having charge or control of the animal, exhibition of the license and tag for such animal, if it is required to be licensed by Chapter 7.12 of the Fort Bragg Municipal Code. No entry shall be made except upon reasonable evidence that such violation is occurring or has in fact occurred. All entries and inspections shall be carried out in accordance with applicable laws, including, but not limited to, the laws pertaining to search warrants and inspection warrants. A search warrant is not required when an Animal Control Officer has probable cause to believe that the keeping or maintaining of an animal on private property is so hazardous or dangerous as to require immediate inspection and/or impoundment of the animal in order to safeguard the safety of the animal, other animals or the public.
