7.12.010 DOG LICENSE REQUIRED.

Every person owning a dog which is harbored within the City shall obtain a license as follows:

A.    Within thirty (30) days after the dog reaches the age of four (4) months.

B.    Within thirty (30) days of becoming a resident of the City if a license is otherwise required under this chapter.

7.12.020 LICENSE REQUIREMENTS NOT APPLICABLE TO CERTAIN DOGS.

The provisions of § 7.12.010 shall not apply to any of the following:

A.    Any dog brought into the City for the purpose of participating in any show, exhibition, field trial or competition scheduled not more than thirty (30) days thereafter.

B.    Any dog brought into the City for the purpose of receiving veterinary care in a veterinary hospital, providing that the dog is confined at all times to the hospital.

C.    Any dog owned or in the possession of a nonresident of the City which is to be maintained in the City for a period not exceeding thirty (30) days in any single calendar year.

7.12.030 LICENSE FEES AND ISSUANCE.

A.    The license fee and any late registration charges shall be in the amount as established from time to time by resolution of the City Council. The license shall be issued to the dog owner upon payment of the current license fee and proof of current rabies vaccination.

B.    Any physically handicapped person using a dog as a recognized assistance dog or any person participating in any youth project for raising dogs for the physically handicapped and submitting documentary proof of such participation shall be issued a dog license without charge upon proof of a valid rabies vaccination.

C.    Any dog owned and used exclusively for law enforcement purposes by a public agency requires a valid rabies vaccination and a valid dog license. The license requested shall be issued without charge upon documentary proof that such dog is certified for law enforcement activities only.

7.12.040 FEE REFUNDS.

No refunds shall be made on any dog license because of the death of or other loss of the dog, or the owner leaving the City prior to the expiration of the license. (Ord. 891, § 2, passed 02-14-2011)

7.12.050 CURRENT RABIES VACCINATION REQUIRED.

No license shall be issued unless evidence of current rabies vaccination is presented to the Humane Society, unless the dog is exempted from the vaccination requirements by State law. (Ord. 891, § 2, passed 02-14-2011)

7.12.060 LICENSE DURATION.

All initial licenses shall be issued for a period commencing on the date of issuance and shall expire on the anniversary date that the rabies vaccination was administered. Renewals are due within thirty (30) days of the anniversary date of the rabies vaccination. (Ord. 891, § 2, passed 02-14-2011)

7.12.070 ISSUANCE OF LICENSE TAG.

A permanent metallic license tag shall be issued with the initial dog license. The tag shall bear an identification number, the words “Fort Bragg” and the year of issuance. (Ord. 891, § 2, passed 02-14-2011)

7.12.080 SECURING TAG TO COLLAR.

The dog owner shall secure the tag to a collar, harness or similar device attached to the dog for which the license tag was issued. The dog owner and/or possessor shall ensure that the dog wears such a license tag at all times except when the dog is being exhibited at field, obedience, or other shows or exhibitions. 7.12.090 REPLACEMENT OF TAG.

Whenever a license tag is lost or damaged, the owner shall apply for and secure a replacement from the Humane Society upon payment of the prescribed fee. (Ord. 891, § 2, passed 02-14-2011)

7.12.100 TRANSFER OF TAG PROHIBITED.

License tags shall not be transferred from one dog to another. (Ord. 891, § 2, passed 02-14-2011)

7.12.110 CHANGE OF ADDRESS OR OWNERSHIP.

The address of the owner is presumed to be the address where the dog is kept. The owner of a licensed dog shall report any change of address to the Humane Society no later than thirty (30) days following a change of address. The owner of a licensed dog shall report the transfer of ownership or custody of the dog no later than thirty (30) days after the change occurs. (Ord. 891, § 2, passed 02-14-2011)

7.12.120 PRESENTATION OF LICENSE ON REQUEST.

Upon request of an Animal Control Officer or any Police Officer, the owner of any dog shall present the dog license for such dog to the officer for inspection. (Ord. 891, § 2, passed 02-14-2011)

7.12.130 IMPOUNDMENT OF UNLICENSED DOG.

An Animal Control Officer may take up and impound any dog that is off the premises of its owner without a current license tag on its collar, harness or other device. The Animal Control Officer shall not impound any dog that is exempt from license/tag requirements by this chapter. (Ord. 891, § 2, passed 02-14-2011)
