1.01.010 Adoption—Secondary codes adopted.

Pursuant to the provisions of Sections 50022.1 through 50022.10 of the Government Code of the state of California, there is adopted the “Foster City Code,” including the following secondary codes incorporating by reference in whole or in part the following parts of Title 24 of the California Code of Regulations, Parts 2 (Volumes 1 and 2), 2.5, 3, 4, 5, 6, 9, 10 and 11:

A.    Code entitled “California Building Code,” 2022 Edition, published by the International Code Council, with California amendments;

B.    Code entitled “California Residential Code,” 2022 Edition, published by the International Code Council, with California amendments;

C.    Code entitled “California Mechanical Code,” 2022 Edition, published by the International Association of Plumbing and Mechanical Officials, with California amendments;

D.    Code entitled “California Plumbing Code,” 2022 Edition, published by the International Association of Plumbing and Mechanical Officials, with California amendments;

E.    Code entitled “California Electrical Code,” 2022 Edition, published by the National Fire Protection Association, with California amendments;

F.    Code entitled “California Fire Code,” 2022 Edition, published by the International Code Council, with California amendments;

G.    Code entitled “California Energy Code,” 2022 Edition, published by the International Code Council, with California amendments;

H.    Code entitled “California Green Building Standards Code,” 2022 Edition, published by the International Code Council;

I.    Code entitled “California Existing Building Code,” 2022 Edition, published by the International Code Council;

Save and except those portions of the preceding secondary codes as are deleted, modified or amended by provisions of the Foster City Code.

From and after the effective date of the ordinances codified in this chapter, the Foster City Code shall constitute the penal and regulatory ordinances of the city of Foster City. (Ord. 654 § 2, 2022)

1.01.020 Prior code repealed.

Upon the effective date of the ordinance codified in this chapter, the Foster City Municipal Code shall be repealed. (Ord. 114 § 2, 1975)

1.01.030 Amendments.

A.    Nothing contained in this chapter is intended to affect the validity of Ordinances 105, 106, 107 and 108, or any other ordinances adopted or to be adopted amending the Foster City Municipal Code, which ordinances the city clerk is directed to cause to be incorporated in the Foster City Code, 1975 Edition, upon their respective effective dates.

B.    Pursuant to the authority vested in Section 32, General Provisions, of the California Vehicle Code, the council may take action to amend, add or repeal provisions of Title 10, Vehicles and Traffic of the Foster City Municipal Code, pursuant to Division 11 (commencing with Section 21000) and Division 15 (commencing with Section 35000) of the Vehicle Code.

C.    Upon adoption of any amendment or addition to this code, or upon the repeal of any of its provisions, the city clerk shall certify thereto, and maintain the same filed in her office for ready reference. (Ord. 260 § 3, 1982: Ord. 114 § 3, 1974)

1.01.040 Violations and punishment.

As required by Section 50022.4 of the Government Code of the state of California, the penalty clauses contained in Sections 1.08.010, 1.08.020 and 1.08.030 of the Foster City Code, 1975 Edition, are hereinafter set forth in full as follows:

“1.08.010 Violation—Misdemeanor. No person shall violate any provision or fail to comply with any requirement of this code. A person violating a provision or failing to comply with any of the mandatory requirements of this code is guilty of a misdemeanor.

“1.08.020 Violation—Penalty. A person convicted of a misdemeanor under this code, unless specific provision is otherwise made, shall be punished by a fine of not more than five hundred dollars or by imprisonment in the county jail for a period of not more than six months, or both.

“1.08.030 Separate offenses. Each person is guilty of a separate offense for each and every day during any portion of which the violation of this code is committed, continued or permitted by that person.” (Ord. 114 § 4, 1975)

1.01.050 Tables of contents and index headings not part of code.

The tables of contents appearing at the beginning of each title and chapter, as well as the tables and index in the back of the code, and the title, chapter and section headings are not adopted as part of the Foster City Code, 1975 Edition, but are included for convenience only. Said tables of contents, tables, index and title, chapter and section headings shall not be deemed to govern, limit or modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section. 1.01.060 Effective date.

This chapter and the Foster City Code, 1975 Edition, shall become effective and in full force and effect at 12:01 a.m. on the thirty-first day after passage of the ordinance codified in this chapter. (Ord. 114 § 6, 1975)

1.01.070 Severability.

If any section, subsection, sentence, clause or phrase of this chapter is, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter. The city council declares that it would have adopted the ordinance codified herein and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases are declared invalid.
